Postępowanie dowodowe w sprawach rozwodowych

dc.abstract.enThis master’s thesis presents the issue of evidence in divorce cases. First of all, it describes the institutions of marriage and divorce, including positive and negative premise that affect the decision to decree dissolve a marriage. It presents the decisions contained in the content of the divorce decree, including those concerning children. After discussing the basic concepts of the law of evidence, i.e. the term of evidence, its classification, fact, rules and conclusions of evidence, it focuses on discussing the basic means of evidence, including, among others, evidence from the hearing of parties and testimony of witnesses.
dc.abstract.plNiniejsza praca przedstawia problematykę postępowania dowodowego w sprawach o rozwód. W pierwszej kolejności opisuje instytucje małżeństwa oraz rozwodu w tym przesłanki pozytywne i negatywne, które mają wpływ na orzeczenie rozwiązania związku małżeńskiego. Przybliża rozstrzygnięcia zawarte w treści wyroku rozwodowego, w tym dotyczące dzieci. Po omówieniu podstawowych pojęć prawa dowodowego, tj. terminu dowodu, jego klasyfikacji, faktu, zasad i wniosków dowodowych koncentruje się na omówieniem podstawowych środków dowodowych, w tym m. in. dowodu z przesłuchanie stron i zeznań świadków, Podejmuje zarazem dyskusyjny problem możności dopuszczenia w procesie rozwodowym tzw. dowodów sprzecznych z prawem.
