dc.abstract.enThis dissertation entitled: “ Request for information in intellectual property proceedings” comprehensively characterizes the institution of information claim in the Polish legal order. The thesis draws attention to the difficulties associated with the application of the provisions governing the request for information in practice and presents the proposed ways of interpreting them by representatives of the doctrine. The views presented in the literature both on the grounds of the previously and currently valid regulations governing the institution in question were referred to. It cites the judgments of common courts as well as international courts that affect the application of the provisions regulating the institution in question. The dissertation considers both theoretical and practical problems associated with the institution of an information claim. In addition to discussing the controversies related to the determination of the legal nature of the institution in question, the work brings closer the course of the proceedings triggered by the request for a request for information and characterizes the procedural tools with which the legislator has equipped the obliged party.
dc.abstract.plNiniejsza praca pt.: „Wezwanie do udzielenia informacji w postępowaniu w sprawach własności intelektualnej” kompleksowo charakteryzuje instytucję roszczenia informacyjnego w polskim porządku prawnym. W rozprawie zwrócono uwagę na trudności wiążące się ze stosowaniem przepisów regulujących wezwanie do udzielenia informacji w praktyce oraz przedstawiono proponowane sposoby interpretacji tychże przez przedstawicieli doktryny. Zreferowano poglądy prezentowane w literaturze zarówno na gruncie poprzednio, jak i aktualnie obowiązujących przepisów regulujących przedmiotową instytucję. Przywołano orzeczenia sądów powszechnych a także międzynarodowych, które mają wpływ na stosowanie przepisów regulujących przedmiotową instytucję. W dysertacji rozważono zarówno problemy teoretyczne jak i praktyczne, które wiążą się z instytucją roszczenia informacyjnego. Oprócz omówienia kontrowersji związanych z określeniem charakteru prawnego przedmiotowej instytucji, praca przybliża przebieg postępowania wywołanego wnioskiem o wezwanie do udzielenia informacji oraz charakteryzuje narzędzia procesowe w które ustawodawca wyposażył obowiązanego.
