Pojęcie dobrej i złej wiary w kontekście zasiedzenia

Praca magisterska dotyczy pojęcia dobrej wiary w kontekście zasiedzenia. Wywód rozpoczyna się od omówienia instytucji zasiedzenia tzn. jego podmiotów, przedmiotów oraz przesłanek. Kolejny rozdział dotyczy pojęcia dobrej wiary, jej pozycji w polskim systemie prawnym, a dokładnie w Kodeksie cywilnym, ustawie o księgach wieczystych i hipotece oraz Kodeksie rodzinnym i opiekuńczym. Przedstawione jest także kodeksowe domniemanie dobrej wiary, pojęcie złej wiary oraz wzajemna relacja tych pojęć. Ostatni rozdział prezentuje trzy najważniejsze koncepcje dobrej wiary: liberalną, pośrednią i tradycyjną, orzecznictwo, które się do nich odwołuje, wraz z wnioskami. Wskazane są również modele samych koncepcji oraz ich cechy. Każdy podrozdział kończy się oceną omawianej koncepcji i określeniem stopnia jej współczesnego wykorzystania w orzecznictwie. Autor dochodzi do wniosku, iż dominującą koncepcją dobrej wiary jest koncepcja tradycyjna. Jednocześnie uznaje, ją za najlepszą koncepcję prezentowaną przez polską naukę prawa, poddając krytyce pozostałe koncepcje.

The Master's thesis deals with the concept of good faith in the context of adverse possession. The thesis begins with a discussion of the institution of adverse possession i.e., its subjects, objects and prerequisites. The next chapter concerns the notion of good faith, its position in the Polish legal system, specifically in the Civil Code, the Act on Land Registers and Mortgages and the Family and Guardianship Code. The Code's presumption of good faith, the concept of bad faith and the mutual relationship of these concepts are also presented. The last chapter presents the three most important concepts of good faith: liberal, indirect and traditional, the case law that refers to them, together with conclusions. Models of the concepts themselves and their features are also indicated. Each subsection concludes with an assessment of the concept under discussion and an indication of the extent to which it has been used in case law today. The author concludes that the dominant concept of good faith is the traditional concept. At the same time, he recognizes it as the best concept presented by the Polish science of law, criticizing the other concepts.
