dc.abstract.enNowadays abuse is a problem that contributes to enormous harm in the form of, for example, permanent damage to mental as well as physical health and the breakdown of the basic cells of social development, families. In this paper, the author will focus on considering whether the legal regulations currently adopted by the legislator are fully effective in providing adequate institutional support to the victim. In the face of a growing number of negative events that have recently stirred public opinion, associated with a kind of tacit consent or tacit acquiescence of society to the perpetration of abuse in the family environment, the lack of reaction from institutions that were obliged to take any reaction, the author will seek an answer to the question of whether the current legal regulations are burdened with a sufficient criminal sanction and whether the current regulations fulfil their preventive function.
dc.abstract.plZnęcanie się współcześnie stanowi problem przyczyniający się do ogromnych krzywd w postaci choćby trwałych uszczerbków na zdrowiu psychicznym, jak i fizycznym oraz na rozbiciu podstawowych komórek społecznego rozwoju, rodzin. W niniejszej pracy autorka skupi się na rozważaniu czy aktualnie przyjęte przez ustawodawcę regulacje prawne są w pełni skuteczne, zapewniając ofierze odpowiednie wsparcie instytucjonalne. W obliczu coraz to liczniejszych, negatywnych wydarzeń, jakie ostatnio poruszyły opinię publiczną, związanych z niejako milczącą zgodą czy też cichym przyzwoleniem społeczeństwa na popełnianie przestępstwa znęcania się w środowisku rodzinnym, braku reakcji instytucji, których obowiązkiem było podjęcie jakiejkolwiek reakcji, autorka poszukiwać będzie odpowiedzi na pytanie, czy aktualne regulacje prawne obarczone są wystarczającą sankcją karną oraz czy obecne regulacje spełniają swoją funkcję prewencyjną.
