Sytuacja prawna pracownika wykonującego pracę zdalną

dc.abstract.enThis master's thesis, “Legal Situation of an Employee Performing Remote Work,” is devoted to the legal regulations on the provision of remote work, introduced as a result of the amendment of the Labor Code on April 7, 2023.The essence of this master's thesis was to make an in-depth analysis of the regulations on remote work, which replaced the previously functioning legal construction of telework. The thesis mainly covers issues concerning the code definition of remote work, occasional remote work, the procedure for the introduction of remote work by the employer, the definition of the rules for remote work by agreement, and the protection of the voluntariness of remote work. The preparation of the thesis took place less than a year after the introduction of the regulations on telework, which implied limited access to the jurisprudence that is only just taking shape in this area of law. In view of the foregoing, the author used the available literature on the subject, the explanatory memorandum to the amendments to the Labour Code and the previous interpretations of the bodies applying the law with regard to certain provisions on telework. A detailed analysis of the provisions on telework enabled the author to assess them positively and to identify legal norms that may give rise to divergent views in the doctrine in the future.
dc.abstract.plPrzedmiotowa praca magisterska Sytuacja prawna pracownika wykonującego pracę zdalną jest poświęcona regulacjom prawnym dotyczącym świadczenia pracy zdalnej, wprowadzonym w wyniku nowelizacji Kodeksu Pracy w dniu 7 kwietnia 2023 r. Istotą niniejszej pracy magisterskiej było dokonanie pogłębionej analizy przepisów dotyczących pracy zdalnej, które zastąpiły funkcjonującą wcześniej konstrukcję prawną telepracy. Praca obejmuje głównie zagadnienia dotyczące kodeksowej definicji pracy zdalnej, okazjonalnej pracy zdalnej, procedurę wprowadzenia pracy zdalnej przez pracodawcę, określenie zasad wykonywania pracy zdalnej w drodze porozumienia, a także ochronę dobrowolności pracy zdalnej. Sporządzenie przedmiotowej pracy magisterskiej przypadało na niecały rok po wprowadzeniu regulacji dotyczących pracy zdalnej, co implikowało ograniczony dostęp do orzecznictwa, które dopiero się kształtuje w tej dziedzinie prawa. Z uwagi na powyższe, autorka posłużyła się dostępną literaturą przedmiotu, uzasadnieniem do nowelizacji Kodeksu Pracy oraz wcześniejszą wykładnią organów stosujących prawo w zakresie niektórych przepisów dotyczących telepracy. Szczegółowa analiza przepisów dotyczących pracy zdalnej umożliwiła autorce ich pozytywną ocenę oraz zidentyfikowanie norm prawnych, które w przyszłości mogą być powodem powstania rozbieżności w poglądach doktryny.
