Wybrane problemy polskiego więziennictwa w świetle orzeczeń Europejskiego Trybunału Praw Człowieka
Abstrakt (PL)
Niniejsza praca magisterska została poświęcona analizie wybranych problemów występujących w polskim więziennictwie, zidentyfikowanych w orzecznictwie Europejskiego Trybunału Praw Człowieka. Oprócz omówienia najbardziej powszechnych z nich, zawiera ona również syntetyczne przedstawienie podstawowych zagadnień związanych z prawami człowieka oraz krajowymi i międzynarodowymi mechanizmami odpowiedzialnymi za ich ochronę. Szczególną uwagę poświęcono przy tym prawom osób pozbawionych wolności, wobec czego przedstawiona została ewolucja ich praw na przestrzeni wieków, a także obowiązujące obecnie standardy międzynarodowe w tym zakresie.
Celem pracy jest jednak nie tylko analiza praw osób osadzonych w jednostkach penitencjarnych oraz wykrytych w polskim systemie więziennictwa problemów, ale również próba wskazania możliwych kierunków zmian, które mogłyby przyczynić się do poprawy sytuacji osób pozbawionych wolności w zakresie respektowania przysługujących im praw człowieka. W celu sformułowania aktualnych i uzasadnionych postulatów de lege ferenda niniejsza praca przedstawia także obecną strukturę i funkcjonowanie polskiego systemu więziennictwa oraz środki wdrożone zarówno przez Polskę, jak i inne państwa w odpowiedzi na wskazane przez Europejski Trybunał Praw Człowieka problemy.
Abstrakt (EN)
This master's thesis is devoted to the analysis of selected issues occurring in the Polish prison system, as identified in the case law of the European Court of Human Rights. In addition to discussing the most common of these issues, it also provides a concise overview of the fundamental aspects of human rights and the national and international mechanisms responsible for their protection. Particular attention is given to the rights of persons deprived of their liberty; therefore, the thesis presents the historical development of these rights over the centuries, as well as the currently applicable international standards in this area.
However, the aim of this thesis is not only to analyze the rights of individuals incarcerated in penitentiary institutions and the problems identified within the Polish prison system, but also to attempt to indicate possible directions for reform that could help improve the situation of persons deprived of their liberty in terms of the respect for their human rights. In order to formulate current and well-founded de lege ferenda proposals, this thesis also presents the existing structure and functioning of the Polish penitentiary system, as well as the measures implemented by both Poland and other countries in response to the problems identified by the European Court of Human Rights.
