Ochrona konstytucyjnych praw oraz wolności człowieka i obywatela w kontekście funkcjonowania służb specjalnych w Polsce

dc.abstract.en	The subject of this thesis is civil rights and freedoms in the context of the operations of special services in Poland. The analysis covers both individual human rights and the powers granted to special services, as well as the circumstances under which these rights may be violated during the activities of such agencies. This issue is of great importance for the proper functioning of a democratic state governed by the rule of law. The Constitution of the Republic of Poland guarantees every citizen personal inviolability and personal freedom. Deprivation or restriction of liberty may occur only under the principles and procedures defined by law. The powers of the special services are very broad, and at the intersection of their operations and the lives of ordinary citizens, situations may arise in which fundamental rights and freedoms are infringed. This raises the question of whether it is permissible for special services to restrict personal freedoms when ensuring public safety is necessary, and whether the current legal framework provides effective oversight of such operations to guarantee the protection of citizens' rights and freedoms. The aim of this thesis is to examine the actual protection of the personal rights and freedoms of Polish citizens in the context of the functioning of special services.
dc.abstract.pl	Przedmiotem pracy są prawa i wolności obywatelskie w kontekście działania służb specjalnych w Polsce. Analizie poddano zarówno poszczególne prawa człowieka, jak też uprawnienia służb specjalnych oraz okoliczności, w których te prawa mogłyby zostać naruszone w trakcie działań służb. Ta problematyka jest bardzo istotna dla prawidłowego funkcjonowania demokratycznego państwa prawa. Konstytucja Rzeczypospolitej Polskiej zapewnia każdemu obywatelowi nietykalność osobistą i wolność osobistą. Pozbawienie lub ograniczenie wolności może nastąpić tylko na zasadach i w trybie określonych w ustawie. Uprawnienia służb są bardzo szerokie a na styku funkcjonowania służb i zwykłych obywateli mogą pojawić się sytuacje naruszające podstawowe prawa i wolności tych ostatnich. Powstaje zatem pytanie, czy dopuszczalne jest ograniczenie wolności osobistych człowieka przez służby specjalne w razie konieczności zapewnienia bezpieczeństwa w obliczu określonych jego zagrożeń i czy w obecnym stanie prawnym kontrola działań służb jest na tyle skuteczna aby zagwarantować obywatelom poszanowanie ich praw i wolności. Celem pracy jest zbadanie faktycznej ochrony praw i wolności osobistych Polaków w kontekście funkcjonowania służb specjalnych.
