Nabywanie nieruchomości oraz udziałów lub akcji w spółce handlowej przez cudzoziemców na gruncie prawa polskiego

dc.abstract.en	The master's thesis focuses on an in-depth analysis of the entire process of acquiring real estates and shares or stocks in a commercial company by foreigners under Polish law. The initial part of the master's thesis includes the presentation of a historical outline. Then there is presented the interpretation of the regulations covering the relevant legal norms from the point of view of such acquisition with usage of the position of the judicature and doctrine, as well as the relevant legal acts from the point of view of the issue in question, divided into the issues of clarification of the legal status of a foreigner, the methods of such an acquisition or the necessary conditions for obtaining a permit for it. The last part of the master's thesis ends with a case study analysis of selected, most common cases of foreigners' acquisition of real estates and shares or stocks in a commercial company in Poland. The whole thesis aims to bring the reader closer look to the overall problem of such acquisition in the theoretical and practical spheres, with a critical approach to the discussed regulations.
dc.abstract.pl	Praca magisterska skupia się na dogłębnej analizie całości procesu nabywania nieruchomości oraz udziałów lub akcji w spółce handlowej przez cudzoziemców na gruncie prawa polskiego. Początkowa część pracy zawiera ukazanie rysu historycznego. Następnie jest prezentowana wykładnia regulacji obejmujących relewantne normy prawne z punktu widzenia takiego nabycia z użyciem stanowiska judykatury i doktryny oraz istotnych z punktu widzenia omawianego zagadnienia aktów prawnych poprzez podział na kwestie wyjaśnienia statusu prawnego cudzoziemca, sposobów tak nakreślonego nabycia czy chociażby niezbędnych warunków do uzyskania na nie zezwolenia. Ostatnią część pracy kończy analiza case study wybranych, najpowszechniej występujących przypadków dokonywania przez cudzoziemców nabywania nieruchomości czy udziałów lub akcji w spółce handlowej na terenie Polski. Całość pracy ma na celu przybliżenie czytelnikowi całościowy problem takiego nabycia w sferze teoretycznej i praktycznej, przy krytycznym podejściu do omawianych regulacji.
