dc.abstract.en	This master's thesis is dedicated to the analysis of the role of judicial experts in the Polish justice system, with particular emphasis on their functioning in criminal proceedings. Judicial experts provide courts with necessary specialist knowledge, which often determines the final verdict. Despite their significant role, the institution of judicial experts in Poland faces numerous problems, such as the lack of comprehensive legal regulation and a central register of experts, which may affect the quality of their services and the efficiency of court proceedings. The thesis discusses the legal status of experts, the method of their appointment, as well as their rights and obligations. It also analyses the functioning of experts in Poland, pointing out the difficulties related to expert evidence and systemic problems, such as low remuneration. The methodology chapter presents the author's own research, conducted in the form of interviews with ten judicial experts. The research aimed to identify factors affecting the problems in the functioning of judicial experts. Qualitative methods were used, which allowed for an in-depth understanding of the experts' perspectives and their perception of their role. Based on the research results, recommendations for reforms were formulated in the discussion, including the need to introduce a new, comprehensive law regulating the activities of judicial experts and changes in the remuneration system.
dc.abstract.pl	Praca magisterska poświęcona jest analizie roli biegłych sądowych w polskim systemie wymiaru sprawiedliwości, ze szczególnym naciskiem na ich funkcjonowanie w postępowaniach karnych. Biegli sądowi dostarczają sądom niezbędnej wiedzy specjalistycznej, która często decyduje o ostatecznych wyrokach. Mimo istotnej roli, instytucja biegłych napotyka w Polsce liczne problemy, takie jak brak kompleksowej regulacji prawnej i centralnego rejestru biegłych, co może wpływać na jakość świadczonych przez nich usług oraz efektywność postępowań sądowych. W pracy omówiono status prawny biegłych, sposób ich powoływania, a także prawa i obowiązki. Analizie poddano również funkcjonowanie biegłych w Polsce, wskazując na trudności związane z dowodami z opinii biegłych oraz problemy systemowe, takie jak zbyt niskie wynagrodzenia. Rozdział metodologiczny prezentuje badania własne, przeprowadzone w formie wywiadów z dziesięcioma biegłymi sądowymi. Badania te miały na celu zidentyfikowanie czynników wpływających na problemy w funkcjonowaniu biegłych sądowych. Wykorzystano metody jakościowe, które pozwoliły na dogłębne zrozumienie perspektyw biegłych i ich postrzegania swojej roli. Na podstawie wyników badań w dyskusji sformułowano rekomendacje dotyczące reform, w tym potrzeby wprowadzenia nowej, kompleksowej ustawy regulującej działalność biegłych sądowych oraz zmiany systemu wynagrodzeń.
