Nadużycia związane z wykorzystaniem wizerunku i głosu osób publicznych przy zastosowaniu technologii deepfake

dc.abstract.en	This thesis provides a comprehensive analysis of the abuses associated with the use of the image and voice of public figures through deepfake technology. First, the concept of a deepfake is explained, including its origins, evolution, types, and methods of application. The legal definition of the deepfake phenomenon is also discussed. Next, a public figure is characterized from both legal and psychological perspectives. In addition, the concepts of image and voice are presented under the law. Subsequently, the issue of pursuing claims and seeking legal protection against the creation and dissemination of deepfakes is addressed. Finally, the thesis includes reflections on the consequences of generated content for public figures and society, as well as on the adequacy of current legal frameworks.
dc.abstract.pl	W niniejszej pracy dokonano kompleksowej analizy problemu nadużyć związanych z wykorzystywaniem wizerunku i głosu osób publicznych przy zastosowaniu technologii deepfake. W pierwszej kolejności wyjaśnione zostało czym jest deepfake. Przedstawiona została jego geneza, ewolucja oraz rodzaje i metody zastosowania. Omówiona została prawna definicja zjawiska deepfake. Następnie scharakteryzowana została osoba publiczna pod względem prawnym, jak i psychologicznym. Oprócz tego przedstawiono wizerunek i głos w świetle prawa. Kolejno, omówiono zagadnienie dochodzenia roszczeń i ochrony prawnej za tworzenie i rozpowszechnianie deepfake’ów. Praca zawiera rozważania na temat skutków istnienia wygenerowanych treści dla osób publicznych oraz społeczeństwa, a także nad wystarczalnością obecnych rozwiązań prawnych.
