NOWELIZACJA DEFINICJI ZGWAŁCENIA W PRAWIE KARNYM W KONTEKŚCIE ZOBOWIĄZAŃ MIĘDZYNARODOWYCH POLSKI

dc.abstract.enThis thesis is devoted to the analysis of the amendment to the definition of rape in the Polish Criminal Code of 2024, which entered into force in February 2025. This amendment added, to the previously existing grounds of the use of violence, unlawful threat or deceit, the ground of committing this offence in another way without consent. The aim of the thesis is to examine the introduced solutions in the light of Poland’s international obligations in the field of human rights protection and their place within the broader European trend of shaping criminal law concerning sexual violence. The thesis analyses the standards derived from fundamental international legal instruments, such as the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence, the International Covenant on Civil and Political Rights, the European Convention on Human Rights, and the Convention on the Elimination of All Forms of Discrimination against Women. It also takes into account the jurisprudence of the European Court of Human Rights and the CEDAW Committee regarding the obligation of states to criminalise acts violating sexual autonomy and bodily integrity. An important element of the thesis is the comparative legal perspective, including an analysis of solutions adopted in other European countries. Two dominant legislative models are presented: the affirmative consent model (“yes means yes”), in which the active confirmation of the will to participate in sexual contact is decisive, and the “no means no” model, based on the criminalisation of conduct undertaken against an explicitly expressed objection. This comparison serves as a reference point for assessing the evolution of Polish regulations. The thesis also discusses the previous construction of the offence of rape in force until 2025, along with its subjective and objective elements. It analyses such features as unlawful threat, deceit, or violence, as well as the individual types of rape. Particular attention is devoted to interpretative and practical problems that for years accompanied the application of Article 197 of the Criminal Code. Another subject of analysis is the legislative process leading to the adoption of the amendment. Both the arguments in favour of the change—related to the need to increase legal certainty, take into account the psychological realities of victims’ reactions, and adapt regulations to international standards—as well as critical voices pointing to potential interpretative and evidentiary problems, are considered. The thesis also attempts to show how the new definition fits into the existing judicial practice and what consequences it may bring for the system of criminal law and the protection of individual rights.
dc.abstract.plNiniejsza praca poświęcona jest analizie nowelizacji definicji zgwałcenia w polskim kodeksie karnym z 2024 r., która weszła w życie w lutym 2025 r. Zmiana ta dodała do dotychczasowych przesłanek użycia przemocy, groźby bezprawnej lub podstępu, przesłankę popełnienia tego przestępstwa w inny sposób bez zgody. Celem pracy jest zbadanie wprowadzonych rozwiązań w świetle międzynarodowych zobowiązań Polski w zakresie ochrony praw człowieka oraz ich miejsca w szerszym, europejskim nurcie kształtowania prawa karnego dotyczącego przemocy seksualnej. W ramach pracy przeanalizowano standardy wynikające z podstawowych aktów prawa międzynarodowego, takich jak Konwencja Rady Europy o zapobieganiu i zwalczaniu przemocy wobec kobiet i przemocy domowej, Międzynarodowy Pakt Praw Obywatelskich i Politycznych, Europejska Konwencja Praw Człowieka oraz Konwencja w sprawie likwidacji wszelkich form dyskryminacji kobiet. Uwzględniono również dorobek orzeczniczy Europejskiego Trybunału Praw Człowieka oraz Komitetu CEDAW, odnoszący się do obowiązku państw w zakresie penalizacji czynów naruszających autonomię seksualną i integralność cielesną jednostki. Istotnym elementem pracy jest ujęcie prawnoporównawcze, obejmujące analizę rozwiązań przyjętych w innych państwach europejskich. Przedstawiono dwa dominujące modele legislacyjne: model afirmatywnej zgody (“yes means yes”), w którym istotne jest aktywne potwierdzenie woli uczestniczenia w kontakcie seksualnym, oraz model „no means no”, oparty na penalizacji zachowań podejmowanych wbrew wyraźnie wyrażonemu sprzeciwowi. Porównanie to stanowi punkt odniesienia dla oceny ewolucji polskich regulacji. Praca omawia także wcześniejszą konstrukcję przestępstwa zgwałcenia obowiązującą do 2025 r., wraz z jej elementami podmiotowymi i przedmiotowymi. Przeanalizowane zostały takie znamiona jak groźba bezprawna, podstęp czy przemoc, a także poszczególne typy zgwałcenia. Szczególna uwaga została poświęcona problemom interpretacyjnym i praktycznym, które przez lata towarzyszyły stosowaniu art. 197 k.k. Kolejnym przedmiotem analizy jest proces legislacyjny prowadzący do przyjęcia nowelizacji. Uwzględniono zarówno argumenty przemawiające za zmianą – związane z potrzebą zwiększenia pewności prawa, uwzględnieniem realiów psychologicznych, reakcji ofiar oraz dostosowaniem regulacji do standardów międzynarodowych – jak i głosy krytyczne, wskazujące na potencjalne problemy interpretacyjne i dowodowe. W pracy podjęto również próbę ukazania, w jaki sposób nowa definicja wpisuje się w dotychczasową praktykę orzeczniczą oraz jakie konsekwencje może nieść dla systemu prawa karnego i ochrony praw jednostki.
