KONWERSJA POSTĘPOWANIA SĄDOWEGO NA ARBITRAŻ

dc.abstract.enThe conversion of litigation to arbitration is a mechanism enabling the parties to proceedings pending before a national court, until a final decision is reached, to refer the dispute to an arbitral tribunal for resolution. The court shall discontinue the proceedings upon a joint application by the parties submitted after they have entered into an arbitration agreement, unless it follows from the content of that agreement and the circumstances of the case that this would be contrary to the law or the principles of social coexistence, or would amount to an attempt to circumvent the law, or the arbitration agreement is invalid or ineffective. The basis for conversion is an arbitration agreement concluded in the form of a submission agreement, i.e. after the dispute has arisen. This institution was expressly introduced into the Code of Civil Procedure in 2023. Its aim was to encourage the parties to resolve disputes outside the national courts, and consequently to reduce the workload on those courts and shorten the duration of proceedings. Conversion entails certain legal consequences as specified in the statutes. Firstly, the limitation period for claims covered by the arbitration clause begins anew from the date on which the order to discontinue proceedings becomes final. Secondly, in such a case, the court shall, of its own motion, refund three-quarters of the claim fee paid to the party. Furthermore, it is impermissible for the case to be re-examined by a common court, which shall, of its own motion, dismiss the claim or the application to initiate non contentious proceedings. Nevertheless, the conversion of litigation into arbitration has not caught on in practice. The parties either do not abandon their case before the national courts, or they bring it before an arbitration tribunal from the outset.
dc.abstract.plKonwersja postępowania sądowego na arbitrażowe to mechanizm umożliwiający stronom postępowania zawisłego przed sądem powszechnym poddanie sporu pod rozstrzygnięcie sądu polubownego aż do momentu prawomocnego rozstrzygnięcia sprawy. Sąd umorzy postępowanie sądowe na zgodny wniosek stron złożony po zawarciu przez strony zapisu na sąd polubowny, chyba że z treści tego zapisu i okoliczności sprawy wynika, iż byłoby to sprzeczne z prawem, zasadami współżycia społecznego lub zmierzałoby do obejścia prawa albo zapis na sąd polubowny jest nieważny lub bezskuteczny. Podstawą konwersji jest zapis na sąd polubowny zawierany w formie kompromisu, tj. po wszczęciu sporu. Instytucja ta została expressis verbis wprowadzona do kodeksu postępowania cywilnego w 2023 r. Jej celem było zachęcenie stron do rozstrzygania sporów poza sądami powszechnymi, a w konsekwencji zmniejszenie obciążenia ich pracą i skrócenie czasu trwania postępowań. Dokonanie konwersji wiąże się z określonymi w ustawach skutkami. Po pierwsze, termin przedawnienia objętych zapisem na sąd polubowny roszczeń zaczyna biec od nowa od dnia uprawomocnienia się postanowienia o umorzeniu postępowania. Po drugie, sąd w takim przypadku z urzędu zwraca stronie 3/4 uiszczonej opłaty od pozwu. Ponadto niedopuszczalne jest ponowne rozpatrzenie danej sprawy przez sąd powszechny, który z urzędu odrzuca pozew lub wniosek o wszczęcie postępowania nieprocesowego. Niemniej konwersja postępowania sądowego na arbitrażowe nie przyjęła się w praktyce. Strony albo nie rezygnują z prowadzenia sporu przed sądem powszechnym, albo od samego początku toczą go przed sądem polubownym.
