The Standard of Proof in Investor - State Arbitration

dc.abstract.enThrough investor-State arbitration, foreign investors may pursue claims directly against the host State before an arbitral tribunal. Investor–State arbitration operates within a multilayered legal framework, in which a fundamental distinction must be drawn between the law governing the arbitral procedure and the law applicable to the substance of the dispute. In ICSID arbitration, the procedural framework constitutes a self contained system governed by the ICSID Convention and ICSID Arbitration Rules, whereas in non ICSID proceedings procedural matters are in principle governed by the law of the seat, often supplemented by institutional or ad hoc arbitration rules. The law applicable to the substance is primarily determined by the parties' agreement, and in its absence by applicable conflict of laws rules. The standard of proof guides the adjudicator as to the degree of conviction required for a fact to be considered established and influences the allocation of risks of erroneous outcomes. It must be distinguished from both the free evaluation of evidence and the burden of proof, while remaining closely interconnected with each. The standard of proof is not defined uniformly across legal systems. The analysis demonstrates that arbitral tribunals rarely articulate a single default standard of proof based on the applicable law. Instead, they adopt a pragmatic, issue specific approach, applying different standards depending on the question at stake. In particular, distinct standards emerge in relation to challenges to arbitrators, interim measures, jurisdictional objections, liability, the quantification of damages, and allegations of corruption. Finally, the thesis addresses attempts to challenge arbitral awards on annulment grounds for alleged misapplication of the standard of proof under the ICSID Convention.
dc.abstract.plZa zgodą państwa goszczącego inwestycję, zwykle wyrażoną w umowie międzynarodowej, inwestorzy zagraniczni mogą dochodzić roszczeń bezpośrednio przeciwko niemu przed trybunałem arbitrażowym. Na reżim prawny, w którym funkcjonuje arbitraż inwestycyjny składa się wiele niezależnych systemów prawnych. Należy dokonać podstawowego rozróżnienia pomiędzy prawem postępowania arbitrażowego a prawem właściwym dla istoty sporu. W arbitrażu ICSID ramy proceduralne stanowią samodzielny system, regulowany przez Konwencję ICSID oraz Regulamin Arbitrażowy ICSID. Natomiast, w arbitrażu inwestycyjnym prowadzonym poza ICSID, kwestie proceduralne są co do zasady regulowane przez prawo miejsca arbitrażu, często uzupełniane przez instytucjonalne regulaminy arbitrażowe lub dokonywane ad hoc uzgodnienia stron. Prawo właściwe dla istoty sporu jest przede wszystkim określane przez porozumienie stron, a w jego braku – przez właściwe normy kolizyjne. Stopień dowodu wskazuje organowi rozstrzygającemu stopień przekonania wymagany do uznania danego faktu za udowodniony oraz wpływa na alokację ryzyka błędnych rozstrzygnięć. Należy go odróżnić zarówno od swobodnej oceny dowodów, jak i od ciężaru dowodu, mimo że te pojęcia są ze sobą związane. Stopień dowodu nie jest jednolicie definiowany w różnych systemach prawnych. Analiza pokazuje, że trybunały arbitrażowe rzadko formułują jeden domyślny stopień dowodu pochodzący z prawa właściwego. Zamiast tego, stosują różne stopnie w zależności od przedmiotu rozstrzygnięcia. W szczególności odmienne stopnie dowodu wyłaniają się w odniesieniu do wniosków o wyłączenie arbitrów, środków zabezpieczających, zarzutów jurysdykcyjnych, odpowiedzialności, ustalania wysokości odszkodowania oraz zarzutów korupcji. Na koniec praca podejmuje zagadnienie kwestionowania orzeczeń arbitrażowych w postępowaniach o stwierdzenie nieważności na podstawie Konwencji ICSID, ze względu na zarzucane błędne zastosowanie stopnia dowodu.
