| dc.abstract.en | This thesis examines the legal discourse of the International Military Tribunal at Nuremberg Trials. It focuses on the argumentative strategies used by both the prosecution and the defense. This study analyzes argumentative techniques employed during IMT proceeding. It also reflects on what the prosecutors and defence attorneys attempted to achieve with the use of them. The typology of argumentative techniques that was a foundation for this study is Perelman and Olbrechts-Tyteca’s The New Rhetoric. A Treatise on Argumentation (1971). The study also refers to Aristotle’s rhetorical appeals from Rhetoric (4th century BCE). Analysing transcripts from the Harvard Nuremberg Trials Project, the research explores how each side constructed their arguments. The examination focuses on the initial speeches made by four prosecutors and four defence attorneys. The results show that defence attorneys often used different techniques than prosecutors. The most common techniques applied by prosecutors include: “rule of justice”, “the group and its members”, “arguments by comparison” and “model and anti-model”. When it comes to defense, the most frequently used strategies were: “breaking of connecting links and dissociation”, “severance and restraint opposed to the act-person interaction” and “contradiction and incompatibility”. However, some of the strategies were employed by both sides, though to achieve different goals. These techniques include: “the person and his acts” , “argumentation by example” and “the <appearance-reality> pair”. The findings show how applying argumentative techniques can influence the outcome of the trials. This study highlights the historical and legal importance of the Nuremberg Trials. |
| dc.abstract.pl | Niniejsza praca stanowi analizę dyskursu prawniczego podczas posiedzeń Międzynarodowego Trybunału Wojskowego w trakcie procesów norymberskich. Badanie skupia się na strategiach argumentacyjnych wykorzystywanych zarówno przez prokuratorów, jak i adwokatów. Praca analizuje techniki argumentacyjne stosowane podczas postępowania. Ponadto praca ma na celu zbadanie w jakich celach prokuratorzy i adwokaci zastosowali te właśnie techniki. Badanie opiera się na typologii technik argumentacyjnych przedstawionej przez Perelmana i Olbrechts-Tytecę w The New Rhetoric. A Treatise on Argumentation (1971), a także na narzędziach perswazji Arystotelesa z Retoryki (IV w. p.n.e.). Praca analizuje zapisy procesów udostępnione w ramach projektu Harvard Nuremberg Trials Project. Opierając się na dostępnych materiałach, praca ma na celu zbadanie, w jaki sposób każda ze stron budowała swoje argumenty. Analizie poddane są wstępne przemowy czterech prokuratorów i czterech adwokatów. Wyniki pokazały, że prokuratorzy i adwokaci często stosowali odmienne strategie. Strategie, które były najczęściej wykorzystywane przez prokuratorów to: „zasada sprawiedliwości”, „grupa i jej członkowie”, „argumenty przez porównanie” oraz „wzór i antywzór”. W przypadku obrony, najczęściej stosowanymi strategiami były: „zrywanie powiązań i rozszczepianie”, „oddzielenie czynu od osoby” oraz „sprzeczność i niezgodność”. Niektóre strategie, choć w różnych celach, stosowane były przez obie strony. Należały do nich: „osoba i jej czyny”, „argumentacja przez przykład” oraz „para pozór/ rzeczywistość”. Wyniki badania pokazują, jak techniki argumentacyjne mogą wpłynąć na postępowanie sądowe. Praca pokazuje jakie znaczenie miały procesy norymberskie w historii i prawie. |
