Polityczność sądu konstytucyjnego

dc.abstract.en	The thesis examines the evolution of constitutional courts in Europe through the lens of the triad of politicality: the political, politics, and policies. It begins from the claim that constitutional courts have always operated within a tension between the constituent power, expressing the original will of the political community, and the constituted power, embedded in everyday political conflict. The work discusses the theories of Hans Kelsen and Carl Schmitt, describes the post-war consolidation of the liberal constitutional order, and analyses the subsequent expansion of constitutional courts into the domain of public policy. In the section devoted to the Polish experience, it outlines the limited legitimacy of the 1997 Constitution, the shifting position of the Polish Constitutional Tribunal, and its eventual subordination to the executive branch. The thesis argues that the role of the constitutional court is not static but is continuously shaped by ongoing struggles over the foundations of the constitutional order.
dc.abstract.pl	Praca analizuje ewolucję pozycji sądów konstytucyjnych w Europie, ujmując ją w triadzie polityczności: the political, politics oraz policies. Punktem wyjścia jest teza, że instytucja ta od samego początku funkcjonowała w napięciu między władzą konstytuującą, wyrażającą pierwotną wolę wspólnoty, a władzą ukonstytuowaną, uwikłaną w codzienne konflikty polityczne. Praca omawia koncepcje Hansa Kelsena oraz Carla Schmitta, opisuje umocnienie się liberalnego porządku konstytucyjnego po II wojnie światowej oraz późniejszy proces wkraczania sądów konstytucyjnych w sferę polityk publicznych. W części dotyczącej polskich doświadczeń przedstawiono ograniczoną legitymizację Konstytucji z 1997 roku, zmienną pozycję Trybunału Konstytucyjnego oraz jego podporządkowanie władzy wykonawczej. Praca dowodzi, że rola sądu konstytucyjnego nie ma charakteru statycznego, ale jest efektem aktualnego sporu o fundamenty ustroju.
