Powództwo przedstawicielskie - instrument ochrony ogólnych interesów konsumentów

dc.abstract.enThe aim of this paper is to analyze representative actions introduced into the Polish legal system by the Act of 24 July 2024 amending the Act on the pursuit of claims in group proceedings and certain other acts (Journal of Laws of 2024, item 1237). Representative actions are an instrument developed on the basis of EU law. They were introduced by Directive (EU) 2020/1828 of the European Parliament and of the Council of 25 November 2020 on representative actions for the protection of the collective interests of consumers and repealing Directive 2009/22/EC (OJ EU L 409 of 2020, p. 1, as amended). The dissertation consists of four main chapters. The first part of the work characterizes the definition of a consumer and the evolution of consumer protection at EU and national level. It also presents and discusses the types of consumer interests that are subject to protection, as well as the civil law instruments for the protection of collective and group consumer interests that existed prior to the above-mentioned novelty. The rest of the thesis focuses on discussing issues related to the implementation of the aforementioned EU directive, the reasons for its introduction and the objectives it is intended to achieve. Subsequently, the circumstances accompanying the transposition of representative actions into Polish law are described, including the implementation proposals considered by the Polish legislator. The last part of the thesis is devoted to characterizing both types of representative actions (i.e. actions for a declaration of practices infringing the collective interests of consumers and actions for claims related to practices infringing the collective interests of consumers), their common structural elements and the exact types of consumer interests they are intended to protect.
dc.abstract.plPraca ma na celu analizę powództw przedstawicielskich wprowadzonych do polskiego porządku prawnego ustawą z 24 lipca 2024 r. o zmianie ustawy o dochodzeniu roszczeń w postępowaniu grupowym oraz niektórych innych ustaw (Dz.U. 2024 r. poz. 1237). Powództwa przedstawicielskie są instrumentem wykształconym na gruncie prawa unijnego. Zostały wprowadzone dyrektywą Parlamentu Europejskiego i Rady (UE) 2020/1828 z 25 listopada 2020 r. w sprawie powództw przedstawicielskich wytaczanych w celu ochrony zbiorowych interesów konsumentów i uchylającą dyrektywę 2009/22/WE (Dz. U. UE. L. z 2020 r. nr 409, str. 1 z późn. zm.). Dysertacja składa się z czterech rozdziałów. W pierwszej części pracy scharakteryzowane zostało pojęcie konsumenta i ewolucja jego ochrony na gruncie unijnym i krajowym. Przedstawione i omówione zostały również rodzaje interesów konsumentów podlegających ochronie, a także cywilnoprawne instrumenty ochrony zbiorowych i grupowych interesów konsumentów istniejące przed ww. nowelizacją. Dalsza część pracy koncentruje się na omówieniu zagadnień związanych z implementacją wspomnianej dyrektywy unijnej, przyczyn jej wprowadzenia i celów, jakie ma realizować. Następnie opisane zostały okoliczności towarzyszące transponowaniu powództw przedstawicielskich do prawa polskiego, w tym propozycje implementacyjne rozważane przez polskiego ustawodawcę. Ostatnia część pracy poświęcona została scharakteryzowaniu obu typów powództw przedstawicielskich (tj. powództwa o stwierdzenie stosowania praktyk naruszających ogólne interesy konsumentów i powództwa o roszczenia związane ze stosowaniem praktyk naruszających ogólne interesy konsumentów), ich wspólnych elementów konstrukcyjnych i rodzajów interesów konsumentów, jakie mają one realizować.
