Wnoszenie pism procesowych za pośrednictwem portalu informacyjnego w postępowaniu cywilnym

dc.abstract.en	The introduction of the option to file certain pleadings through the court information portal represents a significant expansion of the scope of electronic communication with the court that was previously permitted, and also constitutes the next stage in the ongoing process of digitizing civil proceedings. This study examines the objectives of the digitization of proceedings, as well as the concepts of “original” as they relate to electronic documents and electronic signatures. By design, the discussion is limited to that aspect of electronic communication with the court which involves the filing of pleadings. The study analyzes existing solutions in this area currently in force in Poland and other selected countries, including the history of the introduction and development of these solutions. On this basis, an analysis was conducted of the new regulations concerning the filing of pleadings through an information portal in civil proceedings. Based on this, conclusions were drawn, focusing primarily on the need to develop a coherent and comprehensive implementation plan for further regulations regarding the digitization of civil proceedings. It was also emphasized that the new solutions should not merely transfer existing regulations to digitized proceedings, but rather, above all, fulfill the objectives of civil proceedings and the digitization process itself.
dc.abstract.pl	Wprowadzenie możliwości wnoszenia niektórych pism procesowych za pośrednictwem portalu informacyjnego oznacza istotne rozszerzenie dopuszczalnego dotychczas zakresu elektronicznej komunikacji z sądem, jak również stanowi kolejny etap postępującego procesu informatyzacji postępowania cywilnego. W ramach opracowania rozważone zostały cele informatyzacji postępowania, jak również pojęcia oryginału w odniesieniu do dokumentów elektronicznych czy podpisu elektronicznego. Rozważania z założenia ograniczone zostały do tego aspektu elektronicznej komunikacji z sądem, który obejmuje wnoszenie pism. Przeanalizowano dotychczasowe rozwiązania w tym zakresie obowiązujące w Polsce oraz innych wybranych państwach, w tym także historię wprowadzenia i rozwijania tychże rozwiązań. Na tej podstawie przeprowadzono analizę nowych regulacji związanych z wnoszeniem pism procesowych poprzez portal informacyjny w postępowaniu cywilnym. W oparciu o to sformułowane zostały wnioski, obejmujące przede wszystkim konieczność opracowania spójnego i kompleksowego planu wdrażania dalszych regulacji w zakresie informatyzacji postępowania cywilnego. Podkreślono również, że nowe rozwiązania powinny nie tyle przenosić istniejące regulacje do postępowania zinformatyzowanego, ile przede wszystkim realizować cele postępowania cywilnego oraz samej informatyzacji.
