| dc.abstract.en | In the late Middle Ages, there was a significant regression in the legal protection of the domestic peace in the Holy Roman Empire compared to the era of the Hohenstaufen dynasty. The decomposition of royal power and the increasing autonomy of many fragmented feudal territorial authorities underpinned an extremely complex, inefficient organisation of the judiciary, on which the people of the state could not rely to assert their rights. These circumstances, combined with the general institutional weakness of the medieval state, meant that it was often preferable to settle legal disputes on one's own, resorting to the traditional institution of the feud. The feud constituted armed self-help and was a manifestation of the decentralisation of violence in medieval systemic conditions. However, it should not be seen as chaotic lawlessness prevailing due to the powerlessness and helplessness of the authorities. This institution was one of the key elements of the legal order of the Empire. It derived from a customary system of norms with its roots in Old Germanic tribal times, while custom was the primary source of law and its eventual change under the influence of statutory law was very protracted - especially in view of the relative weakness of those attempting it. Due to the impossibility of permanently abolishing the institution of the feud, it was instead subjected to restrictions, frameworks and rules were imposed on it. This was done in the legislation of the so-called Landfrieden, under the influence of which a set of permanent, even ritualised rules for the conduct of the feud was formed. As long as these rules were adhered to, the person conducting a feud remained within a perfectly legal sphere. Eventually, a permanent ban on the feud was introduced at the dawn of the modern era, but the success of its implementation depended on major institutional and social changes. |
| dc.abstract.pl | W późnym średniowieczu miał miejsce w Rzeszy Niemieckiej istotny regres prawnej ochrony pokoju wewnętrznego w porównaniu do epoki rządów dynastii Hohenstaufów. Dekompozycja władzy królewskiej i rosnąca autonomia wielu rozdrobnionych feudalnych władztw terytorialnych stały u podłoża niezwykle skomplikowanej, niewydolnej organizacji sądownictwa, na którym ludność państwa nie mogła polegać w dochodzeniu praw. Okoliczności te, w połączeniu z ogólną instytucjonalną słabością średniowiecznego państwa, sprawiły, że często preferowano rozstrzyganie sporów prawnych na własną rękę, sięgając do tradycyjnej instytucji wróżdy. Wróżda stanowiła zbrojną samopomoc, była przejawem decentralizacji przemocy w średniowiecznych warunkach ustrojowych. Nie należy jednak postrzegać jej jako chaotycznego bezprawia panującego ze względu na niemoc i bezradność władzy. Instytucja ta była jednym z kluczowych elementów porządku prawnego Rzeszy Niemieckiej. Wywodziła się ze zwyczajowego systemu norm korzeniami sięgających starogermańskich czasów plemiennych, zaś zwyczaj był podstawowym źródłem prawa i jego ewentualna zmiana pod wpływem aktów prawa stanowionego była bardzo długotrwała – szczególnie w obliczu relatywnej słabości podmiotów próbujących jej dokonać. Wobec niemożności trwałej likwidacji instytucji wróżdy, poddawano ją ograniczeniom, nakładano na nią ramy i reguły. Dokonywano tego w ustawodawstwie tzw. pokojów ziemskich, pod którego wpływem ukształtował się zespół trwałych, zrytualizowanych wręcz zasad prowadzenia wróżd. Tak długo jak przestrzegano owych zasad, poruszano się w sferze w pełni, bezspornie legalnej. Finalnie, u progu nowożytności wprowadzono permanentny zakaz wróżdy, lecz powodzenie jego implementacji uzależnione było od zajścia gruntownych przemian instytucjonalnych i społecznych. |
