Mediacja obligatoryjna – polska perspektywa na tle międzynarodowym

dc.abstract.en	The aim of this paper is to address the key issues related to mandatory mediation in civil cases. The author analyses the regulation of mediation in Polish, Czech, British and Italian law (as well as in European law) in the context of the possibility of implementing mandatory mediation in civil matters into Polish civil proceedings. The paper discusses cross-sectional statistical data indicating the number of mediations in the last several years in Poland. The author also conducted a survey in the form of a questionnaire, which serves to show in a visual way what directions of changes concerning mandatory mediation are indicated by society. On the basis of an analysis of legal regulations, statistical data and the public's perception of mediation, the author proposes de lege ferenda changes, which will create a framework for the introduction of mandatory mediation in civil matters in Poland.
dc.abstract.pl	Przedmiotem niniejszej pracy jest omówienie kluczowych zagadnień związanych z mediacją obligatoryjną w sprawach cywilnych. Autor analizuje regulację mediacji w prawie polskim, czeskim, brytyjskim, włoskim (a ponadto w prawie europejskim) w kontekście możliwości wprowadzenia mediacji obligatoryjnej w sprawach cywilnych do polskiego postępowania cywilnego. W pracy omówione są przekrojowe dane statystyczne wskazujące na ilość mediacji w ostatnich kilkunastu latach w Polsce. Autor przeprowadził również badanie w postaci ankiety, które służyć ma poglądowemu ukazaniu jakie kierunki zmian dotyczące mediacji obligatoryjnej wskazywane są przez społeczeństwo. Autor na podstawie analizy regulacji prawnych, danych statystycznych oraz odbioru mediacji w społeczeństwie wysuwa postulaty zmian de lege ferenda, które stworzą ramy dla wprowadzenia mediacji obligatoryjnej w sprawach cywilnych w Polsce.
