Nadużywanie pozycji dominującej poprzez wykorzystywanie prawa własności intelektualnej

dc.abstract.en	The paper addresses the issue of abuse of a dominant position through the use of intellectual property rights in the cases of the European Union courts. It discusses the concept of competition law and its purpose in the context of economic integration within the European Union. The position of legal doctrine on the relationship between competition law and intellectual property law will be also analyzed. Additionally, a detailed analysis of the concept of dominant position and its abuse in the view of Article 102 of the Treaty on the Functioning of the European Union. Key concepts at the intersection of law and economics, such as market definitions, monopoly, and competition, are also presented. Finally, based on examples from case law, the paper illustrates the stance of the Court of Justice of the European Union and the European Commission, as the antitrust authority, on the abuse of a dominant position through the exploitation of intellectual property rights.
dc.abstract.pl	Praca podejmuje problematykę nadużywania pozycji dominującej przy wykorzystaniu praw własności intelektualnej w orzecznictwie sądów Unii Europejskiej. Omówiono pojęcie prawa konkurencji oraz jego cel w kontekście integracji gospodarczej w Unii Europejskiej. Przeanalizowano stanowisko doktryny dotyczące relacji pomiędzy prawem konkurencji a prawem własności intelektualnej. Ponadto przedstawiono szczegółową analizę pojęcia pozycji dominującej i jej nadużywania w świetle Artykułu 102 Traktatu o Funkcjonowaniu Unii Europejskiej. Zaprezentowano również kluczowe pojęcia z pogranicza prawa i ekonomii, takie jak definicje rynku, monopolu oraz konkurencji. Wreszcie, na podstawie przykładów z orzecznictwa, ukazano stanowisko Trybunału Sprawiedliwości oraz Komisji Europejskiej, jako organu antymonopolowego, wobec nadużywania pozycji dominującej poprzez wykorzystywanie praw własności intelektualnej.
