Wewnętrzne i międzynarodowe uwarunkowania ochrony ludności rdzennej w Kanadzie

dc.abstract.enThe dissertation covers the topic of the protection of indigenous peoples in Canada and in the world. Indigenous peoples are a group that functioned long before the arrival of colonizers from Europe. The author describes the history of development of the international protection of indigenous peoples and the history and elements of their origins on current Canadian territories. The international law grants different rights and privileges to aboriginal peoples through documents such as the United Nations Declaration on the Rights of Indigenous Peoples or the American Declaration on the Rights of Indigenous Peoples. Colonialism, which began in the XVth century irrevocably affected the native populations, leading to thousands of deaths and displacements. The assimilation policies that followed in the XVIIIth and the XIXth century further worsened indicators such as state of health, level of poverty or education. To this day, past policies impact the indigenous, as demonstrated by different statistics indicated in this dissertation. Furthermore, the situation of the aboriginal peoples will be shown in comparison to countries such as the United States of America and New Zealand.
dc.abstract.plPraca porusza temat ochrony ludności rdzennej w Kanadzie i na świecie. Jest to grupa społeczna, która funkcjonowała jako samowystarczalna wspólnota przed pojawieniem się osadników z Europy. Autorka opisuje historię rozwoju ochrony międzynarodowej autochtonów oraz historię i cechy ich pochodzenia na obecnych ziemiach Kanady. W świetle prawa międzynarodowego, członkom społeczności autochtonów przysługują prawa i przywileje na tle społecznym, kulturalnym czy ekonomicznym. Dokumenty takie jak Deklaracja Praw Ludności Tubylców ONZ czy Amerykańska Deklaracja Praw Ludów Tubylczych są tego potwierdzeniem. Kolonializm, zapoczątkowany w XV wieku, nieodwracalnie wpłynął na dobrobyt ludności rdzennej, doprowadzając do licznych śmierci i przesiedleń. Następne polityki asymilacyjne obecne w XVIII i XIX wieku tym bardziej pogorszyły takie wskaźniki jak stan zdrowia, poziom biedy czy edukacji. Do dziś mają one swój wpływ na tubylców, co widoczne jest po licznych statystykach przedstawionych w pracy. Dodatkowo, sytuacja autochtonów kanadyjskich zostanie przedstawiona na tle takich państw jak Stany Zjednoczone Ameryki czy Nowa Zelandia.
