Transitional justice and sexual violence: an analysis of Sierra Leone's Truth and Reconciliation Commission and the Residual Special Court for Sierra Leone

dc.abstract.enThis thesis investigates how hybrid transitional justice mechanisms addressed conflict-related sexual violence (CRSV) in the aftermath of Sierra Leone’s civil war. Focusing on the Truth and Reconciliation Commission (TRC) and the Special Court for Sierra Leone (SCSL), it offers a critical assessment of both institutions’ contributions and limitations in responding to gender-based harm. Drawing on feminist theory and international legal analysis, the study interrogates the gap between legal norm production and the lived experiences of survivors. It argues that while the TRC and SCSL advanced global jurisprudence, such as criminalising forced marriage and setting important precedents, they often failed to incorporate survivor-centred, locally grounded approaches. Using qualitative methods and institutional case study analysis, the thesis explores how gender, culture, and power shaped the implementation and reception of transitional justice. The TRC’s outreach and reparations initiatives were frequently hindered by limited resources and inadequate understanding of local norms, while the SCSL, though groundbreaking in jurisprudence, operated under structural and political constraints that limited its transformative impact. The study concludes that transitional justice must go beyond symbolic legal recognition to engage with underlying inequalities and gendered political economies. Only then can such mechanisms become truly reparative. Sierra Leone’s legacy thus serves as both a milestone in gender justice and a cautionary tale of technocratic and externally driven interventions that overlook community agency.
dc.abstract.plNiniejsza praca analizuje, w jaki sposób hybrydowe mechanizmy sprawiedliwości okresu przejściowego odnosiły się do przemocy seksualnej związanej z konfliktem (CRSV) po zakończeniu wojny domowej w Sierra Leone. Skupiając się na Komisji Prawdy i Pojednania (TRC) oraz Specjalnym Trybunale dla Sierra Leone (SCSL), przedstawia krytyczną analizę wpływu obu instytucji w reagowaniu na przemoc ze względu na płeć. Wykorzystując teorię feministyczną oraz analizę prawa międzynarodowego, badanie ukazuje rozbieżność pomiędzy tworzeniem norm prawnych a realnymi doświadczeniami osób ocalałych. Autorka dowodzi, że choć TRC i SCSL przyczyniły się do rozwoju globalnego orzecznictwa, m.in. poprzez penalizację małżeństw przymusowych i ustanowienie istotnych precedensów, często nie uwzględniały podejścia skoncentrowanego na osobach ocalałych oraz działania tych instytucji nie były zakorzenione w lokalnym kontekście społecznym.
