dc.abstract.en	The thesis presents an analysis of the offence of infanticide regulated under Article 149 of the Penal Code, classified as a privileged form of homicide. The aim of the study is to provide a comprehensive account of the criminal liability of a woman who deprives her newly born child of life while acting during childbirth and under the influence of its course. Particular attention is devoted to the statutory element of “the influence of the course of childbirth”, examined in the context of the actual impact of childbirth on the woman’s psyche and its effect on the formation of the intent to end the child’s life. The thesis also addresses interpretative difficulties concerning the temporal limits of the “period of childbirth”. Medical and psychological perspectives are taken into account as well, thereby demonstrating the multifaceted nature of the issue. The analysis ultimately leads to reflections on the legitimacy of maintaining the privileged classification of this offence within the current legal order and on the possible need for legislative reform.
dc.abstract.pl	Praca przedstawia analizę przestępstwa dzieciobójstwa uregulowanego w art.149 Kodeksu karnego, stanowiącego uprzywilejowany typ zabójstwa. Celem opracowania jest kompleksowe ujęcie problematyki odpowiedzialności karnej kobiety, która pozbawia życia swoje nowo narodzone dziecko, działając w okresie porodu i pod wpływem jego przebiegu. Szczególnej analizie zostało poddane znamię „wpływu przebiegu porodu” w kontekście rzeczywistego oddziaływania porodu na psychikę kobiety i jego wpływu na powzięcie zamiaru pozbawienia życia dziecka. W pracy omówiono także trudności interpretacyjne związane z określeniem granic czasowych „okresu porodu”. Uwzględniono również perspektywę medyczną oraz psychologiczną, ukazując wieloaspektowość problemu. Całość opracowania prowadzi do refleksji nad zasadnością utrzymania uprzywilejowanej kwalifikacji tego czynu w obowiązującym porządku prawnym oraz potrzebą ewentualnych zmian legislacyjnych.
