Postępowanie w przedmiocie sporządzenia aktu poświadczenia dziedziczenia

dc.abstract.en	In this paper, I raise the subject of the procedure for issuing the succession certification deed, which is mainly regulated by the provisions of the Notarial Law. In the introductory chapter, I discuss the general contexts that are important for a comprehensive approach to the procedure of issuing the succession certification deed by a notary. I focus on the constitutional position of a notary, related instruments used to prove the status of the heir, the origins of the institution and the proceedings before a notary in general. Then, I take a look at the subsequent stages of notarial proceedings leading to the performing of the succession certification deed, which represent the main part of notarial inheritance proceedings. First, I look at the preliminary activities of a preparatory nature that precede the performing of the succession certification deed, both informal and those constituting notarial acts such as, in particular, the opening and announcement of a will and the declarations of acceptance of inheritance. Finally, I discuss the succession protocol and the succession certification deed itself viewed as the effect of a complex procedure.
dc.abstract.pl	W pracy podejmuję temat postępowania w przedmiocie sporządzenia aktu poświadczenia dziedziczenia, które w zasadniczej części uregulowane jest przepisami ustawy Prawo o notariacie. W rozdziale wprowadzającym omawiam ogólne konteksty istotne dla kompleksowego ujęcia procedury poświadczenia dziedziczenia przez notariusza. Uwagę kieruję na pozycję ustrojową notariusza, instrumenty pokrewne służące do wykazania statusu spadkobiercy, genezę instytucji i postępowanie przed notariuszem w ogólności. Następnie przyglądam się kolejnym stadiom postępowania notarialnego prowadzącego do sporządzenia aktu poświadczenia dziedziczenia, stanowiącym zasadniczą część notarialnego postępowania spadkowego. W pierwszej kolejności przyglądam się czynnościom wstępnym o charakterze przygotowawczym do sporządzenia aktu poświadczenia dziedziczenia, zarówno niesformalizowanym jak i stanowiącym czynności notarialne takie jak w szczególności otwarcie i ogłoszenie testamentu oraz przyjęcie oświadczeń spadkowych. Na koniec omawiam protokół dziedziczenia oraz sam akt poświadczenia dziedziczenia jako efekt złożonej procedury.
