Piecza naprzemienna w prawie polskim

dc.abstract.enThis master's thesis analyzes the institution of alternating custody in Polish family law and assesses its importance from the perspective of implementing the principle of the child's best interests after parental separation. The choice of the topic is justified by the increasing number of divorces, the changing family model, and the growing awareness of the importance of active participation of both parents in raising a child, particularly after the end of cohabitation, as reflected in the case rulings. The main research hypothesis is that alternating custody, provided that strictly defined conditions are met, such as the parents' willingness and ability to cooperate, the parents' and the child's adaptability, and the parents' provision of stable developmental conditions for the child, can be an optimal form of ensuring the child's best interests after the parents' separation. The analysis leads to the conclusion that alternating custody should not be treated as a universal solution, but as an exceptional one, applied in situations in which both parents demonstrate the appropriate predispositions to jointly exercise parental authority in accordance with the child's best interests despite living apart.
dc.abstract.plNiniejsza praca magisterska jest poświęcona analizie instytucji pieczy naprzemiennej w polskim prawie rodzinnym oraz ocenie jej znaczenia z perspektywy realizacji zasady dobra dziecka po rozstaniu rodziców. Wybór tematu uzasadnia rosnąca liczba rozwodów, zmieniający się model rodziny oraz rosnąca świadomość znaczenia aktywnego udziału obojga rodziców w wychowaniu dziecka, szczególnie po zakończeniu wspólnego pożycia, co znajduje odzwierciedlenie w orzecznictwie sądów powszechnych. Główną hipotezą badawczą jest założenie, że piecza naprzemienna, przy spełnieniu ściśle określonych warunków, takich jak chęć i zdolność rodziców do współpracy, zdolność adaptacyjna rodziców oraz dziecka oraz zapewnienie dziecku stabilnych warunków rozwoju przez rodziców, może stanowić optymalną formę realizacji dobra dziecka po rozstaniu rodziców. Przeprowadzona analiza prowadzi do wniosku, że piecza naprzemienna nie powinna być traktowana jako rozwiązanie uniwersalne, lecz jako rozwiązanie wyjątkowe, stosowane w sytuacjach, w których oboje rodzice przejawiają odpowiednie predyspozycje do zgodnego z dobrem dziecka wspólnego wykonywania władzy rodzicielskiej pomimo życia w rozłączeniu.
