dc.abstract.en	The master's thesis focuses on the analysis of the issue of consent of a minor patient to a medical procedure in the strict sense. The aim of the thesis is to demonstrate how the legal position of a minor patient is shaped within the healthcare system, and what legal mechanisms regulate their ability to express consent or objection to proposed medical interventions. The author of the thesis analyzes the legal status of minor patients and the significance of consent as the basis for the lawful actions of medical personnel, as well as an expression of respect for patient autonomy. Particular attention is paid to the procedure for giving consent to a medical procedure and to the conditions that must be met for such consent to be considered legally valid. A distinction is drawn between the legal situation of patients under the age of 16 and those who are 16 or older but not yet of legal age. It is noted that after reaching the age of 16, a patient acquires the right to co-decide on their treatment, which requires the consent of both the patient and their legal representative. In the case of younger patients, the decision belongs to the legal representative. The thesis also discusses the scope of the powers of legal representatives and de facto guardians, including their rights and obligations in the process of making medical decisions. It takes into account situations of conflict in which either the child or the guardian refuses to give consent for a procedure and also presents the institution of the minor patient's objection to planned treatment. The thesis highlights the need for the further development of legal practice and regulations aimed at more effectively recognizing the subjectivity of minor patients in the process of making therapeutic decisions.
dc.abstract.pl	Praca magisterska została poświęcona analizie problematyki zgody pacjenta małoletniego na zabieg leczniczy sensu stricto. Cel pracy to ukazanie, w jaki sposób ukształtowana jest pozycja prawna pacjenta małoletniego w systemie opieki zdrowotnej oraz to jakie mechanizmy prawne regulują możliwość wyrażania przez niego zgody lub sprzeciwu wobec proponowanych interwencji medycznych. W pracy przeanalizowano status pacjenta małoletniego oraz znaczenie zgody jako podstawy legalności działania personelu medycznego, a także jako wyrazu poszanowania autonomii pacjenta. Szczególną uwagę poświęcono procedurze wyrażania zgody na zabieg leczniczy oraz przesłankom, które muszą być spełnione, aby uznać zgodę za ważną z prawnego punktu widzenia. Zaprezentowano rozróżnienie sytuacji prawnej pacjentów małoletnich poniżej 16. roku życia oraz tych, którzy ukończyli 16 lat, ale nie osiągnęli jeszcze pełnoletniości. Wskazano, że po ukończeniu 16. roku życia pacjent uzyskuje prawo do współdecydowania o swoim leczeniu, co wymaga uzyskania zarówno jego zgody, jak i zgody przedstawiciela ustawowego. W przypadku młodszych pacjentów decydujący głos należy do przedstawiciela ustawowego. Omówiono także zakres kompetencji przedstawicieli ustawowych i opiekunów faktycznych, w tym ich prawa i obowiązki w procesie podejmowania decyzji medycznych. Uwzględniono również sytuacje konfliktowe, w których dochodzi do niewyrażenia zgody na zabieg ze strony dziecka lub opiekuna, a także przedstawiono instytucję sprzeciwu pacjenta małoletniego wobec planowanego leczenia. Praca wskazuje na potrzebę dalszego rozwoju praktyki i przepisów prawnych zmierzających do skuteczniejszego uwzględniania podmiotowości pacjenta małoletniego w procesie podejmowania decyzji terapeutycznych.
