WYKORZYSTANIE ŚLADÓW UŻYCIA BRONI PALNEJ W POSTĘPOWANIU KARNYM

dc.abstract.enThe primary goal of this master's thesis is to analyze the issues related to firearm traces and their use in criminal proceedings. The focus is on presenting definitions and basic concepts relevant to the topic. The evolution of the definition into current Polish legislation is presented, as well as the legal definition of firearms in the context of their correctness from a forensic perspective. Furthermore, the origins of firearms, their development, and the beginnings of their forensic expertise are presented. The construction and operating principles of firearms and ammunition are also discussed, along with their classification from a forensic systematics perspective. The author then focuses on the subject of traces and the mechanisms of their formation as a result of firearm use, including traces on firearms, ammunition, the shooter, and objects struck by the projectile. This thesis also addresses issues related to procedural and forensic activities at the scene of a firearm incident during an examination, and the discovery and securing of traces used in criminal proceedings.
dc.abstract.plZasadniczym celem niniejszej pracy magisterskiej jest analiza problematyki związanej ze śladami użycia broni palnej i ich wykorzystaniem w postępowaniu karnym. Tematyką zainteresowania staje się zaprezentowanie definicji, podstawowych pojęć tematu opracowania. Przedstawiono ewolucję definicji do obecnych przepisów polskiej legislatury, jak również poddano analizie definicję legalną broni palnej w kontekście jej poprawności z perspektywy kryminalistyki. Ponadto zaprezentowano zarówno genezę powstania broni palnej, jej rozwój jak również początki jej kryminalistycznej ekspertyzy. Omówiona została poza tym budowa, zasady działania broni palnej i amunicji oraz przedstawiony jej podział również z punktu widzenia systematyki kryminalistycznej. W dalszej kolejności autor skupia się na przybliżeniu treści dotyczących śladów i mechanizmów ich powstawania w wyniku użycia broni palnej, w tym śladów na broni palnej, amunicji, osobie strzelającego, obiektach rażonych pociskiem. Niniejsza praca porusza również zagadnienia związane z czynnościami procesowo-kryminalistycznymi na miejscu zdarzenia z użyciem broni palnej w toku oględzin, ujawnienia i zabezpieczenia śladów wykorzystywanych w postępowaniu karnym.
