dc.abstract.en	This thesis focuses on the analysis of the legal position of creditors and the rights afforded to them within the framework of bank resolution proceedings, examined from the perspective of the protection of property rights and other proprietary rights, as well as fundamental principles of private law, including the pacta sunt servanda principle and the principle of contractual stability. Particular emphasis is placed on the resolution tools provided for in the BRRD and BRRD II Directives and subsequently implemented into Polish law through the Act on the Bank Guarantee Fund, Deposit Guarantee Scheme and Resolution. The study examines the scope of permissible interference with creditors’ rights through an analysis of key resolution mechanisms, including the bail-in tool, the No Creditor Worse Off (NCWO) principle, and resolution moratoria. The thesis assesses the extent to which public authorities may interfere with the proprietary rights of individuals acting as bank creditors and identifies the legal limits of such interference in light of Article 64 of the Constitution of the Republic of Poland, the principle of proportionality, and standards developed in legal doctrine. The primary objective of the study is to determine whether the resolution framework strikes an appropriate balance between the public interest in maintaining financial stability and the protection of individual property rights, as well as to assess the adequacy of the safeguards available to creditors affected by resolution measures.
dc.abstract.pl	Praca koncentruje się wokół analizy pozycji wierzycieli oraz przysługujących im praw w procesie przymusowej restrukturyzacji (resolution) w świetle ochrony własności i innych praw majątkowych oraz zasad cywilnoprawnych, takich jak zasada pacta sunt servanda czy zasada trwałości umów. Szczególny nacisk położony jest na omówienie instrumentów tego procesu, przewidzianych w dyrektywach BRRD oraz BRRD II, a następnie w ustawie o Bankowym Funduszu Gwarancyjnym, będącym ich implementacją w tej materii. Badanie zakresu dopuszczalnej ingerencji porusza model „bail-in”, zasadę NCWO („no creditor worse off”) czy moratoria. Weryfikacji w tej pracy podlega ingerencja władzy publicznej w prawa majątkowe jednostek, będących wierzycielami banku, i jej granic w kontekście art. 64 Konstytucji, zasady proporcjonalności oraz norm wypracowanych doktrynalnie.
