Groźba karalna w polskim prawie karnym

dc.abstract.en	The purpose of thesis is to discuss and analyze the crime of criminal threat contained in art. 190 § 1 of the Polish Criminal Code, in the chapter entitled „Crimes against freedom”. The introduction to given subject is a presentation of the definition of the crime of threat, the evolution of its existence in former criminal codes, and its interpretation from the perspective of other legal fields. Further on, thesis contains deliberations regarding the features constituting the existance of crime in question. The issues concerning the object of legal protection, the elements of the objective and subjective aspects, as well as doctrinal discrepancies regarding them, were discussed. Thesis also covers the issue of the mode of prosecution in the context of recent changes and the issue of the coincidence of the provisions of criminal threat with other crimes. The culmination of the considerations regarding criminal threat is a discussion of the sanctions provided for it and the practice of their judicial application.
dc.abstract.pl	Celem pracy jest omówienie i analiza przestępstwa groźby karalnej zawartego w art. 190 § 1 Kodeksu karnego, mieszczącego się w rozdziale „Przestępstwa przeciwko wolności”. Wprowadzeniem do podanego tematu jest przedstawienie pojęcia przestępstwa groźby, ewolucji jego istnienia w kodeksach karnych, a także pokazanie z perspektywy innych dziedzin prawa. W dalszej części praca zawiera rozważania dotyczące znamion, jakie składają się na zaistnienie omawianego przestępstwa. Omówiono zagadnienia przedmiotu ochrony przepisu, elementów strony przedmiotowej, strony podmiotowej i rozbieżności w doktrynie na jej temat. W pracy ujęto także kwestię trybu ścigania w kontekście niedawnych zmian oraz zagadnienie zbiegu przepisów groźby karalnej z innymi czynami zabronionymi. Zwieńczeniem rozważań na temat groźby karalnej jest omówienie przewidzianych za nią sankcji oraz praktyki ich sądowego zastosowania.
