Automatyzacja decyzji administracyjnych w Polsce - wyzwania i ograniczenia

dc.abstract.en	The thesis concerns the automation of administrative decisions and the legal limitations associated with this process. The first chapter describes the concept of administrative decisions, focusing on their characteristics, structure, and role within the Polish legal system. It then discusses the concept of automation in the context of solutions based on algorithms and artificial intelligence. The thesis presents selected models and examples of use of automated solutions in public administration. The third chapter aims to identify the limitations of applying automated systems in administration. It analyzes issues such as the lack of algorithmic transparency, algorithmic discrimination, and the impact of the provisions of the Code of Administrative Procedure (KPA) and the General Data Protection Regulation (GDPR) on the possibility of using automated decision-making. The thesis also addresses the role of human involvement in partially automated processes.
dc.abstract.pl	Praca dotyczy automatyzacji decyzji administracyjnych i związanych z tym procesem ograniczeń prawnych. Pierwszy rozdział pracy opisuje zagadnienie decyzji administracyjnych, zwracając uwagę na ich cechy, strukturę i charakterystykę w polskim porządku prawnym. Następnie omówione zostaje pojęcie automatyzacji w kontekście wykorzystania rozwiązań opartych na algorytmach i sztucznej inteligencji. W pracy omówiono wybrane modele i przykłady zastosowania rozwiązań automatycznych w administracji publicznej. Rozdział trzeci ma na celu wskazanie ograniczeń stosowania rozwiązań automatycznych w administracji. Analizie poddano zjawiska braku przejrzystości algorytmów, dyskryminacji algorytmicznej, a również wpływ przepisów KPA i RODO na możliwość stosowania automatycznego rozstrzygania. Przedstawiono również zagadnienie udziału człowieka w procesie częściowo zautomatyzowanym.
