Ewolucja unijnych aktów prawnych w zakresie cyberbezpieczeństwa. Analiza dyrektyw NIS, NIS2 – próba predykcji NIS3

dc.abstract.en	This dissertation aims to introduce the topic of the evolution of the European Union's directives regarding network and information security. The main idea of the thesis is to examine the completeness of the NIS and NIS 2 Directives in order to directly compare them. The comparison of the two pieces of legislation also allows to present a forecast of the future regulations of the potential NIS 3 Directive. In addition, the dissertation allows to get acquainted with the genesis of both cyberspace and cyber security. The thesis presents definitions of these phenomena, proposed by Polish and foreign authors. The dissertation also cites definitions of the discussed areas used in national and international legal systems. The most important regulations contained in the NIS and NIS 2 directives are described, as well as the main differences between the legal acts. Moreover, the thesis addresses the problem of implementation and functioning of the NIS Directive based on European Commission documents. As part of the study, the said legal acts were analyzed for their completeness. The result of the study is to show the evolution in this branch of EU law, along with a description of the most necessary changes that would characterize the NIS Directive 3.
dc.abstract.pl	Niniejsza praca ma na celu przybliżyć tematykę ewolucji dyrektyw Unii Europejskiej regulujących kwestie bezpieczeństwa sieci i informacji. Głównym założeniem pracy jest zbadanie kompletności dyrektyw NIS i NIS 2 w celu bezpośredniego ich porównania. Zestawienie obu aktów prawnych pozwala również na zaprezentowanie prognozy dotyczącej przyszłych przepisów potencjalnej Dyrektywy NIS 3. Oprócz tego, praca pozwala na zapoznanie się z genezą zarówno cyberprzestrzeni jak i cyberbezpieczeństwa. Przedstawione zostały definicje owych zjawisk, zaproponowane przez autorów polskich oraz zagranicznych. Praca przytacza również definicje omawianych obszarów stosowane w krajowych i międzynarodowych systemach prawnych. Opisane zostały najważniejsze regulacje zawarte w dyrektywach NIS i NIS 2, a także główne różnice między aktami prawnymi. Co więcej, praca porusza problem wdrożenia oraz funkcjonowania Dyrektywy NIS bazując na dokumentach Komisji Europejskiej. W ramach badania, analizie zostały poddane rzeczone akty prawne pod kątem ich kompletności. Owocem badania jest ukazanie ewolucji w tej gałęzi unijnego prawa wraz z opisaniem najpotrzebniejszych zmian, które charakteryzowałyby Dyrektywę NIS 3.
