Patenty na drugie zastosowanie medyczne – przedmiot ochrony i naruszenie.

dc.abstract.en	The subject of this master's thesis is an analysis of the institution of second and further medical use patents and an examination of the key issues that are characteristic of this category of patents. The discussion begins with an overview of fundamental concepts of patent law. Subsequently, the origins and evolution of the legal institution under consideration are discussed, along with an overview of the relevant legal framework governing it. The nature of the inventions relating to second medical use is presented. The principles and forms of patent claim construction specific to this institution are outlined, and the requirement of sufficient disclosure is analysed. The thesis also examines the specific features of the examination of patentability prerequisites in the light of the case law of the European Patent Office concerning second medical use, among which only the prerequisite of novelty has been expressly regulated separately. Furthermore, the thesis discusses issues relating to the scope of patent exclusivity and patent infringement, both from a general perspective and in relation to second medical use patents. The scope of protection of second medical use patents is discussed, including the principles governing the interpretation of patent claims, as well as the dispute over the scope of protection arising from the two forms of claim construction. The final part of the thesis presents two case-law-based models for assessing infringement of this type of patent and discusses the approaches adopted in selected jurisdictions. The thesis also attempts to identify a Polish model.
dc.abstract.pl	Przedmiotem pracy magisterskiej jest analiza instytucji patentów na drugie i kolejne zastosowanie medyczne oraz przybliżenie węzłowych zagadnień problemowych charakterystycznych dla tego rodzaju patentów. Rozważania rozpoczęto od przybliżenia podstawowych pojęć prawa patentowego. Następnie omówiono genezę i ewolucję badanej instytucji wraz z przedstawieniem dotyczących jej uregulowań prawnych. Zaprezentowano istotę wynalazków dotyczących drugiego zastosowania medycznego. Zarysowano zasady i formy konstrukcji zastrzeżeń patentowych charakterystycznych dla tej instytucji oraz poddano analizie warunek dostatecznego ujawnienia. Ujęto również specyfikę badania przesłanek zdolności patentowej na tle orzecznictwa Europejskiego Urzędu Patentowego odnośnie do drugiego zastosowania medycznego, z których tylko przesłanka nowości została wprost uregulowana w sposób odrębny. W pracy poruszono także zagadnienia związane z zakresem wyłączności patentowej oraz naruszeniem patentu w ujęciu ogólnym, jak i w odniesieniu do patentów na drugie zastosowanie medyczne. Omówiono zakres przedmiotowy patentu na drugie zastosowanie, w tym zasady wykładni zastrzeżeń patentowych, a także kwestię sporu o zakres ochrony wynikający z dwóch form ich konstrukcji. W końcowej części pracy przybliżono dwa modele oceny naruszenia tego rodzaju patentów wynikające z orzecznictwa oraz omówiono rozwiązania przyjęte w wybranych jurysdykcjach. Podjęto także próbę identyfikacji modelu polskiego.
