Ochrona sygnalistów w polskim prawie karnym: analiza ustawy o ochronie sygnalistów w kontekście regulacji krajowych i międzynarodowych

dc.abstract.enThe subject of this thesis is the presentation of the criminal law regulations contained in the Act of 14 June 2024 on the protection of whistleblowers and their analysis. The author discusses the socio-historical context of the right to the protection of whistleblowers in Poland, conducts an analysis of the criminal law regulations contained in the Act in terms of their meaning, the protected legal goods, the statutory penalty level and the subjectively assessed effectiveness of the implementation of the provisions of Directive 2019/1937. The thesis also takes into account a comparative analysis conducted on the basis of the criminal law provisions of the German law on the protection of whistleblowers, the Hinweisgeberschutzgesetz of 31 May 2023. The thesis undertakes a de lege ferenda reflection on the provisions of the Act in the perspective of the objectives of the Polish and European Union legislators, in particular the effective protection of persons who report or publicly disclose infringement information obtained in a work-related context.
dc.abstract.plPrzedmiotem niniejszej pracy magisterskiej jest przedstawienie uregulowań prawnokarnych zawartych w ustawie z dnia 14 czerwca 2024 r. o ochronie sygnalistów oraz ich analiza. Autor omawia kontekst społeczno-historyczny prawa do ochrony sygnalistów w Polsce, przeprowadza analizę uregulowań prawnokarnych zawartych w ustawie pod kątem ich znaczenia, chronionych dóbr prawnych, ustawowego wymiaru kary oraz ocenianej subiektywnie skuteczności implementacji postanowień Dyrektywy 2019/1937. Praca uwzględnia także analizę porównawczą przeprowadzoną w oparciu o przepisy karne niemieckiej ustawy o ochronie sygnalistów, Hinweisgeberschutzgesetz z dnia 31 maja 2023 r. W ramach pracy podjęto de lege ferenda refleksję nad postanowieniami ustawy w perspektywie celów ustawodawcy polskiego oraz unijnego, w szczególności skutecznej ochrony osób zgłaszających lub ujawniających publicznie informacje o naruszeniu prawa uzyskane w kontekście związanym z pracą.
