Status prawny bezwyznaniowców w II Rzeczypospolitej

dc.abstract.enThis master’s thesis addresses the issue of the legal status of nonbelievers in the Second Polish Republic, focusing on the analysis of the legislation then in force as well as the practice of its application. The primary aim of the study was to determine whether nonbelievers enjoyed genuine equality with citizens professing a religion, or whether they were subject to restrictions of a discriminatory nature. The scope of the research encompassed primarily constitutional acts, the provisions of the so-called the Little Versailles Treaty, as well as civil, criminal, administrative, and educational legislation. The thesis also takes into account the case law of the Supreme Court and the Supreme Administrative Tribunal, which significantly shaped the interpretation of freedom of conscience and religion.  The analysis demonstrated that constitutional guarantees covered both the right to profess a religion and the right not to profess any. However, the legislation in force during the interwar period violated the constitutional standard of protection for nonbelievers, inter alia, through the introduction of compulsory religious education in public schools, the lack of secular forms of marriage throughout the country, the absence of a uniform system of civil status records, and the sanctioning of religious oaths. In addition, criminal provisions penalizing offenses against religious feelings restricted the freedom to manifest non-religious views. It must therefore be concluded that, with regard to religious policy, the Second Polish Republic implemented a compromise model: on the one hand, it incorporated liberal standards of individual rights protection, while on the other, it reinforced the privileged position of the Roman Catholic Church. Consequently, nonbelievers, despite being formally covered by constitutional guarantees of freedom of conscience and religion, were not treated on an equal footing with other citizens and were subject to systemic discrimination.
dc.abstract.plNiniejsza praca magisterska podejmuje problematykę statusu prawnego osób bezwyznaniowych w II Rzeczypospolitej, koncentrując się na analizie obowiązującego ówcześnie ustawodawstwa oraz na praktyce stosowania prawa. Zasadniczym celem badania było ustalenie, czy osoby bezwyznaniowe korzystały z rzeczywistego równouprawnienia wobec obywateli wyznających religię, czy też podlegały ograniczeniom o charakterze dyskryminacyjnym. Zakres badawczy obejmował przede wszystkim akty konstytucyjne, postanowienia tzw. małego traktatu wersalskiego, a także ustawodawstwo cywilne, karne, administracyjne i oświatowe. W pracy uwzględniono również orzecznictwo Sądu Najwyższego i Najwyższego Trybunału Administracyjnego, które wywierało istotny wpływ na sposób interpretacji i stosowania zasady wolności sumienia i wyznania przez organy władzy publicznej. Analiza wykazała, że formalne gwarancje konstytucyjne obejmowały zarówno prawo do wyznawania religii, jak i prawo do niewyznawania żadnej. Jednak obowiązujące w dwudziestoleciu międzywojennym prawo naruszało konstytucyjny standard ochrony bezwyznaniowców m.in. poprzez wprowadzenie obowiązkowego nauczania religii w szkołach publicznych, brak świeckich form zawierania małżeństwa na terenie całego kraju, brak jednolitego systemu aktów stanu cywilnego, czy sankcjonowanie przysięgi religijnej. Dodatkowo przepisy karne penalizujące obrazę uczuć religijnych ograniczały swobodę manifestowania poglądów areligijnych. Należy również wyciągnąć wniosek, że II Rzeczpospolita, jeśli chodzi o politykę wyznaniową, realizowała model kompromisowy: z jednej strony inkorporowała liberalne wzorce ochrony praw jednostki, z drugiej utrwalała uprzywilejowaną pozycję Kościoła rzymskokatolickiego. W konsekwencji osoby bezwyznaniowe, mimo formalnego objęcia konstytucyjnymi gwarancjami wolności sumienia i wyznania, nie były traktowane na równi z innymi obywatelami i podlegały systemowej dyskryminacji.
