Realizacja i ochrona prawa do prywatności, ochrony danych osobowych oraz wolności wypowiedzi i informacji w Internecie na gruncie prawa Unii Europejskiej

dc.abstract.enThe Internet plays an increasingly important role in people’s lives, both in their personal and professional spheres. In addition to its original function—that of an information source—it now serves as a hub for social discourse and a marketplace for Internet service providers. Almost everyone uses the Internet, and escaping it increasingly seems impossible, as both private and public entities are increasingly choosing the web as their primary tool for communicating with their audiences. Online activity is not without impact on fundamental rights, particularly the right to privacy, the right to data protection, and the right to freedom of expression and information. For the right to freedom of expression and information, the Internet is primarily a space for its realization, provided, however, that this does not infringe upon the fundamental rights of others. Conversely, for the right to privacy and the right to data protection, the Internet is a place where violations with exceptionally serious consequences may occur, e.g., in the event of a data breach or the imposition of a general content filtering requirement. The institutions of the European Union appear to be increasingly recognising the importance of the Internet as a space for the exercise of fundamental rights, as evidenced by the case law of the CJEU and the ECtHR, as well as by legislation. In this master’s thesis, I first discuss the case law in which European courts address the role of the Internet as a space for the exercise of rights and the scope of permissible restrictions imposed in accordance with the principle of proportionality. Next, I analyze selected secondary legislation that may have a positive impact on ensuring the proper exercise and protection of the fundamental rights referred to in Articles 7, 8, and 11 of the Charter of Fundamental Rights of the European Union, which stem from the General Data Protection Regulation, the Digital Services Act, and the Digital Markets Act. The principle of proportionality, which is fundamental to all of European law, comes to the fore in the context of both the case law and legislation discussed. The implementation and protection of fundamental rights require that they be properly balanced against other values of the legal system.
dc.abstract.plInternet odgrywa coraz większą rolę w życiu człowieka, zarówno w jego sferze prywatnej jak i zawodowej. Oprócz pierwotnej funkcji sieci tj. funkcji informacyjnej, pełni ona obecnie rolę ośrodka dyskursu społecznego oraz rynku zbytu dla usługodawców internetowych. Z Internetu korzystają prawie wszyscy, a ucieczka przed nim coraz częściej wydaje się być niemożliwa, gdyż podmioty zarówno prywatne jak i państwowe coraz częściej wybierają sieć jako podstawowe narzędzie komunikacji z odbiorcami. Aktywność sieciowa pozostaje nie bez wpływu na prawa podstawowe w szczególności prawo do prywatności, prawo do ochrony danych oraz prawo do wolności wypowiedzi i informacji. Dla prawa do wolności wypowiedzi i informacji Internet jest przede wszystkim przestrzenią jego realizacji, jednakże z zastrzeżeniem, że ta nie może naruszać praw podstawowych innych osób. Z kolei dla prawa do prywatności oraz prawa do ochrony danych Internet jest miejscem gdzie może dojść do wyjątkowo brzemiennego w skutki ich naruszenia np.: w sytuacji wycieku danych czy nałożenia obowiązku ogólnego filtrowania treści. Organy Unii Europejskiej wydają się coraz lepiej dostrzegać znaczenie sieci jako przestrzeni realizacji praw podstawowych, czego dowody odnajdujemy w orzecznictwie TSUE oraz ETPC jak i w legislacji. W niniejszej pracy omawiam w pierwszej kolejności orzecznictwo, w którym europejskie trybunały wypowiadają się na temat roli sieci jako miejsca realizacji praw oraz zakresu dopuszczalnych ograniczeń nakładanych z poszanowaniem zasady proporcjonalności. Następnie analizuję wybrane regulacje z obszaru prawa wtórnego mogące mieć pozytywny wpływ dla zapewnienia należytej realizacji i ochrony praw podstawowych, o których mowa w art. 7, art. 8 oraz art. 11 KPP, które pochodzą z Ogólnego rozporządzenia o ochronie danych, Aktu o usługach cyfrowych oraz Aktu o rynkach cyfrowych. Na pierwszy plan, zarówno w kontekście omawianego orzecznictwa jak i legislacji wysuwa się zasada proporcjonalności, fundamentalna dla całego prawa europejskiego. Realizacja i ochrona praw podstawowych wymaga bowiem ich należytego wyważenia z innymi wartościami systemu prawa.
