Ustawa o kształtowaniu ustroju rolnego w kontekście niektórych zasad konstytucyjnych oraz realizacji celów ustawy

dc.abstract.en	The thesis provides an analysis of the Act of 11 April 2003 on shaping the agricultural system in two interrelated perspectives. The first examines the relationship between selected provisions of the Act and constitutional principles, in particular those concerning the agricultural system, protection of property, the social market economy, the democratic state governed by the rule of law, and the principle of proportionality. The second perspective focuses on the objectives of the Act, their origins, formulation, and the possibility of their implementation through the adopted legal instruments. The analysis also takes into account the amendments introduced in 2016. The methodology is based on the analysis of legal provisions, systemic, functional and linguistic interpretation, as well as the examination of publicly available documents, academic sources, legislative processes, and axiological and comparative approaches. The findings indicate that certain provisions of the Act may be in conflict with selected constitutional principles. It is also demonstrated that the objectives of the Act are formulated inconsistently and are not always reflected in its provisions, while the relationship between the applied legal measures and their implementation is often unclear. Consequently, it is concluded that the Act in its current form raises doubts as to its quality and its compliance with higher-ranking legal norms. The de lege ferenda conclusions include a proposal to change the legal framework governing the transfer of immovable property.
dc.abstract.pl	Praca stanowi analizę ustawy z dnia 11 kwietnia 2003 r. o kształtowaniu ustroju rolnego w dwóch powiązanych ujęciach. W pierwszym z nich zbadano relację wybranych przepisów ustawy do zasad konstytucyjnych, w szczególności stanowiących ustrój rolny, ochronę własności, społeczną gospodarkę rynkową, demokratyczne państwo prawne oraz zasadę proporcjonalności. W drugim ujęciu poddano analizie cele ustawy, ich genezę, sposób sformułowania oraz możliwość ich realizacji przy użyciu przyjętych rozwiązań prawnych. Uwzględniono także zmiany wprowadzone nowelizacją z 2016 r. Metodyka pracy została oparta na analizie treści przepisów, wykładni norm prawnych w ujęciu systemowym, wykładni funkcjonalnej, wykładni językowej, analizie dokumentów dostępnych do publicznego wglądu, analizie źródeł naukowych, analizie procesów legislacyjnych, analizie aksjologicznej, zarysie prawnoporównawczym i propozycjach autora w przedmiocie analizy podnoszonych w wywodzie zagadnień oraz możliwych zagrożeń dla prawa i interesu społecznego. W wyniku przeprowadzonej analizy stwierdzono, że część przepisów ustawy może pozostawać w konflikcie z niektórymi zasadami konstytucyjnymi. Jednocześnie wykazano, że cele ustawy zostały sformułowane niejednolicie i nie zawsze znajdują odzwierciedlenie w przepisach, a związek między zastosowanymi środkami prawnymi a ich realizacją jest w wielu przypadkach nieczytelny. W konsekwencji uznano, że ustawa w obecnym kształcie może budzić wątpliwości co do jej jakości i zgodności z aktem prawnym wyższego rzędu. Wnioski de lege ferenda obejmują postulat zmiany reżimu prawnego obrotu nieruchomościami.
