Okoliczności uzasadniające dopuszczenie dowodu z urzędu w procesie cywilnym

dc.abstract.enThe subject matter of this thesis is the admissibility of ex officio evidence in civil proceedings in contentious matters. The author seeks to answer whether and to what extent the admission of evidence ex officio is compatible with the contemporary model of civil procedure. Additionally, the thesis analyzes the circumstances justifying the admission of such evidence and its relationship with other institutions of civil procedure. The first chapter discusses the evolution of regulations concerning ex officio evidence, from the Code of Civil Procedure of 1930 to the amendments introduced by the revision of the current Code of Civil Procedure in 1996. The second chapter provides a general characterization of the institution of admitting evidence ex officio by the court. The third chapter addresses the circumstances justifying the admission of ex officio evidence in civil proceedings in contentious matters. It examines circumstances that justify such intervention, including collusive litigation, a party lacking mental capacity, or cases handled within specific types of proceedings. It also evaluates circumstances arguing against such intervention, such as a party’s negligence or representation by a professional legal representative. The fourth chapter presents detailed procedural issues related to the admission of evidence ex officio by the court. It explores the influence of the type of evidence on the applicability of this institution and its relationship to the system of limitation for statements and evidence, presumptions of law, the model of evidence procedure before the appellate court, evidence agreement, and the trial plan.
dc.abstract.plPrzedmiotem niniejszej pracy jest dopuszczalność dowodu z urzędu w procesie cywilnym. Autor podejmuje próbę odpowiedzi na pytanie, czy i w jakim zakresie dopuszczenie dowodu z urzędu pozostaje zgodne z aktualnym modelem procesu cywilnego, oraz analizuje okoliczności uzasadniające jego dopuszczenie, a także relacje z innymi instytucjami postępowania cywilnego. W rozdziale pierwszym omówiono ewolucję regulacji dotyczących dowodu z urzędu – od kodeksu postępowania cywilnego z 1930 roku, aż po zmiany wprowadzone nowelizacją obecnego k.p.c. z 1996 roku. Rozdział drugi zawiera ogólną charakterystykę instytucji dopuszczenia dowodu z urzędu przez sąd. Rozdział trzeci dotyczy okoliczności uzasadniających dopuszczenie dowodu z urzędu w procesie cywilnym. Omawia zarówno sytuacje uzasadniające taką ingerencję – jak proces fikcyjny, nieporadność strony czy rozpoznanie sprawy w niektórych postępowaniach odrębnych – jak i okoliczności, które przemawiają przeciwko niej, takie jak niedbałość strony lub jej zastępstwo przez profesjonalnego pełnomocnika. Rozdział czwarty prezentuje szczegółowe zagadnienia procesowe związane z dopuszczeniem dowodu z urzędu przez sąd. Poruszono w nim wpływ rodzaju środka dowodowego na możliwość zastosowania tej instytucji, a także jej relację do systemu prekluzji dowodowej, domniemań prawnych, przyjętego modelu postępowania dowodowego przed sądem II instancji, umowy dowodowej oraz planu rozprawy.
