Dowód z przesłuchania stron w procesie cywilnym

dc.abstract.en	The subject of this work is to demonstrate the specific regulation of evidence from hearing of the parties compared to other means of evidence enumerated in the Code of Civil Procedure. Evidence from the hearing of the parties has been characterized by discussing its essential features, which include subsidiarity, optionality, and symmetry. The entities that may be heard as a party have been presented, along with the course and stages of such hearing. The differences between the parties' testimony and their other statements during the proceedings have been identified, as well as the significance of the latter for the outcome of the proceedings. Finally, issues regarding the probative value of the parties' testimony and their assessment by the court in accordance with the principle of the free evaluation of evidence have been discussed.
dc.abstract.pl	Przedmiotem pracy jest wykazanie specyficznej regulacji dowodu z przesłuchania stron na tle innych środków dowodowych, wymienionych w kodeksie postępowania cywilnego. Dowód z przesłuchania stron został scharakteryzowany poprzez omówienie jego cech istotnych, do których należą: subsydiarność, fakultatywność oraz symetryczność. Przedstawiono podmioty, które mogą zostać przesłuchane w charakterze strony oraz przebieg i etapy takiego przesłuchania. Wykazane zostały różnice między zeznaniami stron, a innymi ich wypowiedziami w procesie oraz znaczenie tych drugich dla wyniku postępowania. Na koniec omówione zostały kwestie dotyczące mocy dowodowej zeznań stron i ich oceny przez sąd zgodnie z zasadą swobodnej oceny dowodów.
