Istota i rola samorządu gospodarczego w systemie gospodarki rynkowej opartej na wolności gospodarczej
| dc.abstract.en | In the current legal system, the institution of economic self-government in a strict sense, understood as an entity performing public administration functions, does not exist. The absence of such an institution deprives the collective actions of Polish entrepreneurs of public-legal subjectivity and administrative authority, thereby excluding them from exerting a tangible influence on the shaping of market order. As a consequence, the lack of chambers of economic self-government during the historical process of Poland’s economic transformation created conditions conducive to pathological lobbying activities, corruption, opaque links between business circles and organised criminal groups, and other unlawful practices that disrupted the market order—often involving certain segments of the political class. Numerous examples of economic scandals, legal violations, legislative malpractice, and the erosion of business ethics and sound practices serve as evidence of this phenomenon. Regrettably, it remains the case that government bureaucracy has, thus far, defended the monopoly of state authority by justifying its refusal to initiate the legislative process for an act on economic self-government with the alleged immaturity of entrepreneurs. Further difficulties in granting economic self-government a proper legal status in Poland also stem, inter alia, from the multiplicity of economic and business organisations operating under diverse legal provisions, many of which—often without sufficient justification—appropriate for themselves the role of economic self-government. This is a misconception. The concept of “self-government” as a public-law institution must not be confused with associations and other entities formed under the constitutional right to freedom of association (Article 58 of the Constitution). Freedom of association entails the liberty of citizens to form organisations for the pursuit of objectives they themselves define. This freedom includes the right to establish social organisations in accordance with separate legal provisions. It is therefore necessary to recognise that two distinct legal concepts are being conflated: the voluntary freedom of entrepreneurs to associate, and the institution of economic self-government, membership in which is compulsory under statute. The former encompasses private business associations and clubs whose influence on market order is indirect, exercised mainly through lobbying. The latter refers to economic self-government as a public-law corporation whose impact on the shaping of market order is direct, as it participates in activities such as the creation of economic legislation. In recent years, several attempts have been made to draft and implement legislation establishing an institution of economic self-government. However, debates concerning its character—particularly whether membership should be mandatory or voluntary—have failed to produce a constructive compromise. Nonetheless, the establishment or restoration of a universal economic self-government in Poland is in the interest of both the state and the entrepreneurial community. Granting public-legal subjectivity to the entrepreneurial community would signify the emergence of a new self-governing body based on economic ties, complementing the existing self-governments founded on territorial bonds. It must also be recognised that such public-legal subjectivity would entail the structural autonomy and institutional separation of the entrepreneurial community as an entity of public authority and administration. This authority is necessary, as it would provide the community with a genuine capacity to influence the shaping of market order and the state’s economic policy. The point of departure should therefore be the legal understanding of self-government, as only such a concept should be employed by the legislator when creating legal institutions intended to operate within the framework of the rule-of-law state. |
| dc.abstract.pl | W obecnym polskim prawodawstwie nie występuje instytucja samorządu gospodarczego sensu stricto, rozumiana jako podmiot wykonujący funkcję administracji publicznej. Nieobecność instytucji samorządu gospodarczego pozbawia działania zbiorowe polskich przedsiębiorców podmiotowości publicznoprawnej i władztwa administracyjnego, a przez to realnego wpływu na tworzenie ładu rynkowego. Trudności z prawnym usankcjonowaniem samorządu gospodarczego w Polsce wynikają też między innymi z dużej liczby organizacji gospodarczych i biznesowych działających na podstawie różnych przepisów, które w nie do końca uprawniony sposób przypisują sobie rolę samorządu gospodarczego. Jest to pewne nieporozumienie. Z pojęciem „samorządu” jako instytucji prawa publicznego nie można mylić bowiem zrzeszeń i innych organizacji realizujących konstytucyjne prawo do swobody zrzeszania się (art. 58 Konstytucji). Wolność zrzeszania oznacza swobodę tworzenia przez obywateli różnego rodzaju organizacji, funkcjonujących dla realizacji wytyczonych przez nie celów. Niewątpliwie prawo wolnościowe zrzeszania to także wolność tworzenia organizacji społecznych na zasadach określonych odrębnymi przepisami. Należy uznać zatem, że miesza się tu dwie materie: wolność zrzeszania się przedsiębiorców z samorządem gospodarczym, do którego przynależność jest obligatoryjna z mocy ustawy. W pierwszym przypadku mamy do czynienia z organizacjami i klubami biznesu o charakterze prywatnych stowarzyszeń, których oddziaływanie na ład rynkowy jest pośredni, głównie za pomocą lobbingu, natomiast w drugim przypadku samorząd gospodarczy jako korporacja publicznoprawna – którego wpływ na kształtowanie ładu rynkowego jest bezpośredni, gdyż z mocy ustawy uczestniczy na przykład w tworzeniu prawa gospodarczego. W ciągu ostatnich lat podejmowano kilka prób stworzenia i wprowadzenia ustawy mającej na celu utworzenie samorządu gospodarczego. Jednak dyskusje na temat charakteru takiego samorządu – tego czy przynależność doń miałaby stać się obowiązkowa czy dobrowolna – nie doprowadziły do pozytywnego kompromisu. Powołanie/przywrócenie powszechnego samorządu gospodarczego w Polsce leży jednak w interesie zarówno rządu, jak i ogółu przedsiębiorców. Upodmiotowienie publicznoprawne społeczności przedsiębiorców oznaczać będzie pojawienie się nowej wspólnoty samorządowej opartej na więzi ekonomicznej, obok wcześniej powstałych wspólnot samorządowych, opartych na więzi terytorialnej. Trzeba też zdawać sobie sprawę, że upodmiotowienie publicznoprawne oznacza też wyodrębnienie i usamodzielnienie ustrojowe samorządowej wspólnoty przedsiębiorców jako podmiotu władzy i administracji publicznej. Władztwo to jest konieczne, bo zapewni owej wspólnocie realny wpływ na kształtowanie ładu rynkowego i politykę gospodarczą państwa. Punktem wyjścia powinno być więc pojęcie samorządu w znaczeniu prawnym, bowiem tylko takim pojęciem powinien posługiwać się ustawodawca tworząc instytucje prawne, mające następnie funkcjonować w ramach państwa prawnego. |
