Udział syndyka masy upadłości w postępowaniu cywilnym

dc.abstract.en	The aim of this thesis is to present the role of the bankruptcy trustee in civil proceedings by defining their legal position, procedural standing, and illustrating the course of civil litigation involving the trustee. In the event of a debtor’s bankruptcy, pursuant to Article 144(1) of the Bankruptcy Law, court proceedings concerning the bankruptcy estate may be initiated and conducted solely by or against the trustee. This provision forms the basis for the trustee’s substitution of the bankrupt party through statutory subrogation. An analysis of the trustee’s role in civil proceedings also requires outlining the objectives of bankruptcy proceedings, which determine the scope of the trustee’s responsibilities. The thesis further discusses the impact of declaring bankruptcy on ongoing civil proceedings and the admissibility of initiating new proceedings related to the bankruptcy estate.
dc.abstract.pl	Praca ma na celu przedstawienie udziału syndyka masy upadłości w postępowaniu cywilnym przez określenie jego pozycji prawnej, legitymacji procesowej oraz zilustrowanie przebiegu postępowania cywilnego z udziałem syndyka. W przypadku ogłoszenia upadłości podmiotu, zgodnie z art.144 ust. 1 p.u., postępowania sądowe dotyczące masy upadłości mogą być wszczęte i prowadzone wyłącznie przez syndyka albo przeciwko niemu. Wskazany przepis stanowi podstawę wstąpienia syndyka do postępowania w miejsce upadłego wskutek subrogacji ustawowej. Podejmując analizę udziału syndyka masy upadłości w postępowaniu cywilnym, konieczne jest również przedstawianie celów postępowania upadłościowego, które warunkują zakres obowiązków syndyka. Następnie przedstawiony zostanie wpływ ogłoszenia upadłości na przebieg postępowania cywilnego będącego w toku oraz wpływ ogłoszenia upadłości na dopuszczalność wszczynania nowych postępowań dotyczących masy upadłości.
