Prawo karne jako ultima ratio na tle konstytucyjnej zasady proporcjonalności

dc.abstract.enThe thesis is about the ultima ratio principle and the principle of proportionality in the context of criminal law. The purpose of this study is the analysis of the aforementioned principles as well as the introduction of the relationship between them within the framework of applicable laws. The indicated issues are of particular significance due to the nature of criminal law as the most intrusive instrument. For this reason, penal repression should be used rationally and only when it is absolutely essential. In order to discuss the subsidiary nature of criminal law, it is essential to refer to the concept of legally protected interest. The thesis presents the evolution of the concept of punishment, from the era in which it was perceived merely as a form of retribution, to the contemporary view emphasizing its protective function. Moreover, the study defines the ultima ratio as well as the principle of proportionality, demonstrating their interrelationship. The final section presents the phenomena of criminal law inflation and penal populism. Furthermore, the thesis provides examples of legal acts and draft bills that raise doubts as to their compliance with the principles under consideration. The analysis leads to the conclusion that these principles are of fundamental importance for the legislative process. Failure to observe them may result in excessive and unnecessary criminalization, which contradicts both the objectives of criminal law and the fundamental assumptions of a democratic state governed by the rule of law.
dc.abstract.plPraca dotyczy zasady ultima ratio oraz zasady proporcjonalności w kontekście prawa karnego. Jej celem jest analiza wskazanych zasad oraz przedstawienie ich relacji na gruncie obowiązujących przepisów prawa. Wskazane zagadnienia mają szczególne znaczenie z uwagi na charakter prawa karnego jako środka najbardziej dolegliwego. Z tego powodu represja karna powinna być stosowana racjonalnie, jedynie wtedy, gdy jest to niezbędne. W celu omówienia subsydiarnego charakteru prawa karnego konieczne jest odwołanie się do pojęcia dobra prawnego. W pracy przedstawiono ewolucję rozumienia kary, od czasów, gdy postrzegano ją jako odpłatę za zło, aż do współczesnego poglądu eksponującego jej wymiar ochronny. Następnie zdefiniowano zasadę ultima ratio oraz zasadę proporcjonalności oraz wskazano na ich powiązanie. W ostatniej części zaprezentowano na zjawisko inflacji prawa karnego oraz populizmu penalnego. Przedawniono także przykłady ustaw i projektów ustaw, które budzą pewne wątpliwości w kontekście zgodności z omawianymi zasadami. Przeprowadzona analiza prowadzi do wniosku, że wskazane zasady są kluczowe z perspektywy stanowienia prawa. Ich nieprzestrzeganie prowadzić możne do nadmiernej i zbędnej kryminalizacji, co stoi w sprzeczności z celami prawa karnego i z założeniami demokratycznego państwa prawa.
