Zasiedzenie nieruchomości rolnej w świetle nowelizacji przepisów - analiza zmian i perspektyw rozwoju

dc.abstract.en	The purpose of this master's thesis is to analyze legislative changes concerning the institution of adverse possession in the context of agricultural properties. The thesis discusses key concepts, the historical background, and legal foundations of adverse possession, as well as the necessary conditions for its acquisition. It also presents the relationship between the institution of adverse possession and the current Constitution, and provides a detailed description of the judicial procedure for declaring adverse possession, supported by extensive case law from common courts and the Supreme Court. The thesis includes an analysis of the legal status of adverse possession of agricultural properties before and after the amendment of 30 April 2016, along with an explanation of the legislator’s motives and a comparative assessment of opinions from agricultural law experts. Special attention is given to the latest amendments to the Act on the Agricultural System and the Civil Code from October 2023, with a particular focus on the subjective aspects of adverse possession of agricultural properties under the current legal framework. The final part of the thesis presents the author’s opinion on the changes made, evaluates the extent to which the legislator’s objectives have been achieved, and proposes specific mechanisms and solutions that could positively influence the further development of regulations concerning adverse possession of agricultural properties.
dc.abstract.pl	Celem niniejszej pracy magisterskiej jest analiza zmian legislacyjnych dotyczących instytucji zasiedzenia w zakresie nieruchomości rolnych. W pracy omówiono kluczowe pojęcia, tło historyczne i podstawy prawne zasiedzenia oraz przesłanki konieczne do jego dokonania. Przedstawiono także relację instytucji zasiedzenia z obowiązującą Konstytucją oraz szczegółowo opisano procedurę sądową związaną ze stwierdzeniem zasiedzenia, popierając analizę bogatym orzecznictwem sądów powszechnych i Sądu Najwyższego. Praca zawiera również analizę stanu prawnego dotyczącego zasiedzenia nieruchomości rolnych przed i po nowelizacji przepisów z 30 kwietnia 2016 roku, wraz z omówieniem motywów ustawodawcy oraz komparatywną oceną poglądów ekspertów prawa rolnego. Szczególna uwaga poświęcona została najnowszej nowelizacji ustawy o kształtowaniu ustroju rolnego i kodeksu cywilnego z października 2023 roku, ze szczególnym naciskiem na podmiotowe aspekty zasiedzenia nieruchomości rolnych zgodnie z aktualnym stanem prawnym. W końcowej części pracy przedstawiono autorską opinię na temat dokonanych zmian, oceniono stopień realizacji celów ustawodawcy oraz zaproponowano konkretne mechanizmy i rozwiązania, które mogłyby korzystnie wpłynąć na dalszy rozwój regulacji dotyczących zasiedzenia nieruchomości rolnych.
