dc.abstract.en	This master's thesis examines the legal permissibility of using copyright-protected works within the framework of internet memes. The analysis focuses on the doctrine of permissible use, comparing the regulatory approaches of the European Union and the United States, with particular emphasis on the parody exception and the fair use doctrine. The thesis draws upon legal acts and case law, while also addressing the challenges posed by the rapidly evolving internet culture. Special attention is devoted to the boundaries of users’ creative freedom and the criteria for assessing the lawfulness of using third-party content. The aim of the thesis is to determine which legal system more effectively balances the interests of original authors with the need for social expression in the digital sphere.
dc.abstract.pl	Niniejsza praca magisterska podejmuje analizę możliwości wykorzystywania utworów chronionych prawem autorskim w konwencji memów internetowych. W centrum rozważań znajduje się instytucja dozwolonego użytku, porównanie regulacji obowiązujących w Unii Europejskiej i Stanach Zjednoczonych, ze szczególnym uwzględnieniem wyjątku parodii oraz doktryny fair use. Praca opiera się na analizie aktów prawnych i orzecznictwa, jednocześnie odnosząc się do wyzwań wynikających z dynamicznego rozwoju kultury internetowej. Szczególną uwagę poświęcono granicom swobody twórczej użytkowników oraz kryteriom oceny dopuszczalności wykorzystania cudzych treści. Celem pracy jest ustalenie, który z systemów prawnych lepiej balansuje takie wartości, jak interes twórcy pierwotnego a potrzebę ekspresji społecznej w przestrzeni cyfrowej.
