“Pominięcie a oddalenie dowodu na gruncie k.p.c. i k.p.k. - analiza prawnoporównawcza”

dc.abstract.enThe manner in which the court proceeds with regard to motions for evidence is of key importance for the implementation of the principles of both civil and criminal proceedings – such as substantive truth, adversarial nature or equality of the parties. The taking of evidence affects the outcome of the case and the quality of the ruling. Therefore, on 7 November 2019, the legislator introduced Article 235² to the Code of Civil Procedure, in which it indicated specific reasons for the omission of motions for evidence. The new provision, although similar to the criminal regulation, has been formulated differently, which gives rise to problems of interpretation. The work is theoretical in nature – it is based on the analysis of regulations, case law and views of the doctrine. Despite the lack of empirical research, the author refers to examples from court practice, pointing to differences in the application of the law. The analysis shows that the ambiguities of the new regulation may lead to divergent rulings, which affects the coherence of the legal system and requires further legislative and judicial reflection.
dc.abstract.plSposób postępowania przez sąd co do wniosków dowodowych ma kluczowe znaczenie dla realizacji zasad zarówno procesu cywilnego jak i karnego – takich jak prawda materialna, kontradyktoryjność czy równość stron. Przeprowadzanie dowodów wpływa na wynik sprawy i jakość orzeczenia. W związku z tym, 7 listopada 2019 r. ustawodawca wprowadził art. 235² do Kodeksu postępowania cywilnego, w którym wskazał konkretne przyczyny pominięcia wniosków dowodowych. Nowy przepis, choć podobny do regulacji karnej, został sformułowany inaczej, co rodzi problemy interpretacyjne. Praca ma charakter teoretyczny – oparta jest na analizie przepisów, orzecznictwa i poglądów doktryny. Mimo braku badań empirycznych, autorka odwołuje się do przykładów z praktyki sądowej, wskazując na różnice w stosowaniu prawa. Analiza pokazuje, że niejasności nowej regulacji mogą prowadzić do rozbieżnych orzeczeń, co wpływa na spójność systemu prawa i wymaga dalszej refleksji legislacyjnej oraz orzeczniczej.
