Swoboda korzystania z przestrzeni a praktyki turystyki biwakowej – wybrane uwarunkowania w Szwecji i Polsce

dc.abstract.enThis thesis analyzes the legal, institutional, and cultural conditions of wild camping in Poland and Sweden, focusing on a comparison between the Swedish allemansrätten model and the Polish 'Become a Dweller of the Forest' ('Zanocuj w lesie') program. The aim of the study was to evaluate the feasibility of adapting the Scandinavian system of public access to nature within the Polish context and to identify the barriers that complicate this transfer. The second chapter presents the legal and institutional foundations of both models. Allemansrätten, enshrined in the Swedish Constitution and the Environmental Code of 1998, allows the free use of natural space with few exceptions, stemming from a deeply rooted outdoor culture. Conversely, the Polish model, based on the Forest Act of 1991 and Decision No. 12 of the Director General of State Forests from 2021, operates asymmetrically. The ban on wild camping is the rule, and access is permitted exclusively within administratively designated zones covering approximately 643,000 hectares. The third chapter is dedicated to the spatial analysis of wild camping infrastructure. Sweden possesses a coherent system of huts, STF hostels, municipal fireplaces, and an unquantifiable area of land for legal camping, supported by a robust network of community maps (campwild.org, vindskyddskartan.se). In contrast, the infrastructure of the Polish program areas is highly fragmented, with its informal equivalent being formed by crowdsourced maps (wiating.eu) and enthusiast groups on social media. Chapters four and five supplement the study with empirical research based on expert interviews with a TOPR mountain rescuer, a forestry engineer, a mountain guide, and a survival instructor, alongside participant observation conducted in Poland and Sweden. The results reveal a three-dimensional typology of transfer barriers: geographical-historical (lack of customary tradition), educational-social (insufficient level of tourism awareness), and legal-property (radically different attitudes toward private property). The experts unanimously agreed that the 'Become a Dweller of the Forest' program is a step in the right direction, but remains an incomplete solution due to institutional dependence on State Forests' decisions and the lack of an extensive overnight infrastructure.
dc.abstract.plW pracy poddano analizie uwarunkowania prawne, instytucjonalne i kulturowe turystyki biwakowej w Polsce i Szwecji, koncentrując się na porównaniu szwedzkiego modelu allemansrätten z polskim programem „Zanocuj w lesie”. Celem pracy była ocena możliwości zaadaptowania skandynawskiego systemu swobodnego dostępu do przyrody w polskich realiach oraz identyfikacja barier, które ten transfer komplikują. W rozdziale drugim przedstawiono prawno-instytucjonalne podstawy obu modeli. Allemansrätten zapisane w szwedzkiej Konstytucji i Kodeksie Środowiskowym z 1998 r., umożliwia swobodne korzystanie z przestrzeni przyrodniczej z nielicznymi wyjątkami, wynikając z głęboko zakorzenionej kultury outdoorowej. Polski model oparty na Ustawie o lasach z 1991 roku i Decyzji nr 12 Dyrektora Generalnego Lasów Państwowych z 2021 roku działa asymetrycznie. Zakaz biwakowania jest regułą, a dostęp możliwy wyłącznie w wyznaczonych administracyjnie strefach obejmujących ok. 643 tys. ha. Rozdział trzeci poświęcono analizie przestrzennej infrastruktury biwakowej. Szwecja dysponuje spójnym systemem chat, schronisk STF, gminnych palenisk i niepoliczalną powierzchnią przestrzeni do legalnego biwakowania wraz z silną strukturą map społecznościowych (campwild.org, vindskyddskartan.se). Infrastruktura obszarów ZWL w Polsce ma charakter wyspowy, a jej nieformalny ekwiwalent tworzą mapy społecznościowe (wiating.eu) i grupy zrzeszające pasjonatów w mediach społecznościowych. Pracę w rozdziale czwartym i piątym uzupełniono badaniami własnymi, które oparto na wywiadach eksperckich z ratownikiem TOPR, inżynierem leśnictwa, przewodnikiem górskim i instruktorem survivalu, wraz z obserwacją uczestniczącą w Polsce i Szwecji. W wynikach wykazano trójwymiarową typologię barier transferu: geograficzno-historyczną (brak tradycji zwyczajowej), edukacyjno-społeczną (niewystarczający poziom świadomości turystycznej) i prawno-własnościową (radykalnie odmienny stosunek do własności prywatnej). Eksperci zgodnie ocenili, że program „Zanocuj w lesie jest krokiem w dobrą stronę, lecz pozostaje rozwiązaniem niekompletnym ze względu na instytucjonalną zależność od decyzji Lasów Państwowych i brak rozbudowanej infrastruktury noclegowej.
