Rola Światowej Organizacji Zdrowia w kształtowaniu standardów opieki medycznej

dc.abstract.en	This paper analyzes the role of the World Health Organization (WHO) in shaping international standards of medical care and assesses the impact of its activities on global healthcare systems. In the era of globalization and growing epidemiological threats, the activities of the WHO constitute the foundation of health security, fulfilling a key coordinating and normative function. The main objective of this study is to analyze the competencies of the WHO and the mechanisms for setting ethical and professional standards. The research examines how the organization's guidelines are implemented into national legal systems, as well as the barriers associated with enforcing non-binding norms. The research section utilizes the legal-dogmatic method, based on the analysis of the WHO Constitution, the International Health Regulations (IHR), and strategic reports. A qualitative analysis of the relevant literature and case studies regarding responses to global health crises was also applied. The structure of the paper consists of three chapters. The first introduces the origins and institutional structure of the WHO as a subject of international law. The second focuses on the organization's normative impact on ethical standards and the combat against infectious diseases. The third chapter is dedicated to enforcement mechanisms and the issue of state and organizational liability for violating international health obligations. The conducted analysis demonstrates that although the majority of WHO regulations constitute so-called soft law, they exert a tangible impact on the harmonization of medical care systems. The primary challenge remains the lack of effective sanctioning mechanisms and the fact that the organization's effectiveness is contingent upon the willingness of member states to cooperate. The conclusion highlights the necessity for reforms that strengthen the WHO's competencies in order to respond more effectively to contemporary cross-border threats.
dc.abstract.pl	Niniejsza praca analizuje rolę Światowej Organizacji Zdrowia w kształtowaniu międzynarodowych standardów opieki medycznej oraz ocenę wpływu jej działań na globalne systemy ochrony zdrowia. W dobie globalizacji i narastających zagrożeń epidemiologicznych, działalność WHO stanowi fundament bezpieczeństwa zdrowotnego, pełniąc kluczową funkcję koordynacyjną i normatywną. Głównym celem pracy jest analiza kompetencji WHO oraz mechanizmów wyznaczania standardów etycznych i zawodowych. W toku badań zbadano sposób wdrażania wytycznych organizacji do krajowych porządków prawnych oraz bariery związane z egzekwowaniem norm o charakterze niewiążącym. W części badawczej wykorzystano metodę dogmatyczno-prawną, opartą na analizie Konstytucji WHO, Międzynarodowych Przepisów Zdrowotnych (IHR) oraz raportów strategicznych. Zastosowano również analizę jakościową literatury przedmiotu oraz studiów przypadku dotyczących reakcji na globalne kryzysy zdrowotne. Struktura pracy obejmuje trzy rozdziały. Pierwszy przybliża genezę i strukturę instytucjonalną WHO jako podmiotu prawa międzynarodowego. Drugi koncentruje się na normatywnym wpływie organizacji na standardy etyczne oraz na zwalczaniu chorób zakaźnych. Trzeci poświęcony jest mechanizmom egzekwowania prawa oraz kwestii odpowiedzialności państw i organizacji za naruszenie międzynarodowych zobowiązań zdrowotnych. Przeprowadzona analiza wykazała, że choć większość regulacji WHO to tzw. miękkie prawo, wywierają one realny wpływ na harmonizację systemów opieki medycznej. Głównym wyzwaniem pozostaje brak skutecznych mechanizmów sankcyjnych oraz uzależnienie efektywności działań organizacji od woli współpracy państw członkowskich. Konkluzja wskazuje na konieczność reform wzmacniających kompetencje WHO w celu skuteczniejszego reagowania na współczesne zagrożenia transgraniczne.
