dc.abstract.en	The bachelor's thesis, titled The Crime of Disclosure or Transfer of State Secret Information, assesses criminal law solutions for the protection of classified information under Article 265 of the Penal Code. The aim of this thesis is to analyze and evaluate criminal law solutions for the protection of classified information, taking into account the scale and importance of this problem. The first chapter describes the historical development of the concept of protecting classified information, its evolution, and its significance in the legislative process. The development of legal norms leading to the current solutions for the protection of classified information and the scope of this protection. The second chapter presents a definition of the concept of classified information, methods of classifying and disclosing it, and presents the origins and purpose of the Act on the Protection of Classified Information in the context of the importance of information in the modern world. The third chapter discusses the legal aspects of the protection of classified information and identifies examples of violations of applicable regulations in public space and contemporary political life. The source material for this thesis included normative acts, court judgments, monographs, and materials published in the press and on the internet. The analysis of the collected materials clearly indicated that information constituting a state secret is important for the state, as its unauthorized disclosure may cause significant damage to the Republic of Poland in the area of its security and sovereignty, and may also threaten the pursuit of economic interests.
dc.abstract.pl	Praca licencjacka pt. „Przestępstwo ujawnienia lub przekazania informacji stanowiących tajemnicę państwową” dotyczy oceny rozwiązań prawnokarnych w zakresie ochrony informacji niejawnych na podstawie art. 265 Kodeksu karnego. Celem niniejszej pracy jest dokonanie analizy i oceny rozwiązań prawnokarnych w zakresie ochrony informacji niejawnych ze względu na skalę i wagę tego problemu. W pierwszym rozdziale opisano historyczny rozwój idei ochrony informacji niejawnych, jej ewolucję oraz znaczenie w procesie legislacyjnym. Wskazano także rozwój norm prawnych prowadzący do obecnych rozwiązań ochrony informacji niejawnych oraz zakresu przedmiotowego i podmiotowego tej ochrony. W rozdziale drugim przedstawiono definicję pojęcia informacji niejawnych, sposób jej klasyfikowania i udostępniania oraz zaprezentowano genezę i cel ustawy o ochronie informacji niejawnych w kontekście znaczenia informacji we współczesnym świecie. Rozdział trzeci zawiera omówienie prawnych aspektów ochrony informacji niejawnych oraz wskazano w nim przykłady naruszenia obowiązujących przepisów w przestrzeni publicznej i we współczesnym życiu politycznym. Podstawę źródłową do pracy stanowiły akty normatywne, wyroki sądowe, prace zwarte, materiały publikowane w prasie oraz Internecie. Analiza zgromadzonych materiałów wskazała jednoznacznie, że informacje stanowiące tajemnicę państwową są ważne dla państwa, gdyż ich nieuprawnione ujawnienie może spowodować znaczną szkodę dla Rzeczpospolitej Polskiej w obszarze jej bezpieczeństwa i suwerenności, a także może zagrozić realizacji interesów gospodarczych.
