System Pegasus jako środek kontroli operacyjnej w Polsce a standardy państwa prawnego

dc.abstract.en„«Pegasus» spyware as a means of operational control and the standards of the rule of law” thesis analyzes use of a special type of surveillance method in context of the legal regulations on the activities of police and intelligence services in Poland. The main issues are: identifying functionalities of Pegasus software, a detailed discussion on the legal standards of using the operational and reconnaissance activities by the services and an attempt to subsume the use of the software in relation to the formulated legal standard allowing the use of operational surveillance in Poland. The emphasis is placed on the importance of constitutional standards rationing individual rights and freedoms by using modern surveillance techniques.
dc.abstract.plPraca licencjacka - „System Pegasus” jako środek kontroli operacyjnej a standardy państwa prawnego - poddaje analizie użycie szczególnego typu metody inwigilacji na tle uregulowań prawnych działania służb policyjnych i specjalnych w Polsce. Głównymi zagadnieniami są zidentyfikowanie funkcjonalności użycia oprogramowania typu „Pegasus”, szczegółowe omówienie norm prawnych regulujących pracę operacyjno-rozpoznawczą służb oraz próbę subsumcji użycia oprogramowania względem sformułowanej w wyniku wykładni normy prawnej dopuszczającej użycie kontroli operacyjnej w Polsce. Podkreślona zostaje waga konstytucyjnych standardów ingerowania w prawa i wolności jednostki z użyciem nowoczesnych technik inwigilacji.
