dc.abstract.en	The work attempts to prove the thesis that the prison as a total system is a mirror of the legal culture of the state , by referring to the concepts proposed by Erving Goffman, Michel Foucoult and the related philosophical and historical context. The of the work shows the evolution of the concept of punishment - from the brutal forms of execution and spectacular executions, through the institutionalization of imprisonment, to its contemporary visions in the legal systems of various countries. The first part of the work presents the philosophical and cultural foundations of punishment, with special emphasis on the thought of Michel Foucault and historical examples. The second chapter is devoted to the theory of total institutions, showing their common features and differences. The main part of the work focuses on analyzing in particular the prison as a total institution, its structure, functions, mechanisms of supervision and control, as well as the role of the prison service. The last chapter presents the prison as a mirror of legal culture - showing how the conditions and functions of the prison reflect the values and level of humanism in selected contemporary legal cultures. The purpose of the work is to show that the prison - as a total system - not only performs repressive, control or rehabilitative functions, but also constitutes a space that reveals the nature of the law, the state and the society in which it functions.
dc.abstract.pl	Praca podejmuje próbę udowodnienia tezy, iż więzienie jako instytucja totalna stanowi lustro kultury prawnej państwa , poprzez odwołanie się do koncepcji zaproponowanych przez Ervinga Goffmana, Michela Foucoult oraz związanego z nimi kontekstu filozoficzno-historycznego. W pracy pokazana została ewolucja pojęcia kary – od brutalnych form kaźni i spektakularnych egzekucji, przez instytucjonalizację więzienia, aż po jego współczesne wizje w systemach prawnych różnych państw. W pierwszej części pracy przedstawiono filozoficzne i kulturowe podstawy karania, ze szczególnym uwzględnieniem myśli Michela Foucaulta oraz historycznych przykładów. Drugi rozdział poświęcony jest teorii instytucji totalnych, w której ukazano ich cechy wspólne i różnice. Główna część pracy koncentruje się na analizie szczególności więzienia jako instytucji totalnej, jego strukturze, funkcjach, mechanizmach nadzoru i kontroli, a także roli służby więziennej. Ostatni rozdział przedstawia więzienie jako zwierciadło kultury prawnej – ukazując, jak warunki i funkcje więzienia odzwierciedlają wartości oraz poziom humanizmu w wybranych współczesnych kulturach prawnych.. Celem pracy jest ukazanie, że więzienie – jako system totalny – nie tylko wykonuje funkcje represyjne, kontrolne czy resocjalizacyjne ale również stanowi przestrzeń ujawniającą charakter prawa, państwa i społeczeństwa, w którym funkcjonuje.
