Preferences and interests of the EU institutions and member states regarding the legal foundations of migration policy

dc.abstract.enThis bachelor's thesis primarily focuses on the legislative process of the European Union's immigration policy, discussing the preferences and interests of member states and institutions behind policy-making, as well as how they influence the final policy outcome by expressing their preferences. This thesis focuses on three stages: “how preferences are generated, how they are expressed, and whether they are ultimately absorbed.” By analyzing these three key points, it attempts to study the trajectory of various parties' preferences throughout the entire legislative process. The theoretical foundation of this thesis is liberal intergovernmentalism, which emphasizes that member states' preferences are not static but are influenced by various domestic political, economic, cultural, and security factors. These factors ultimately lead to differences among nations and can serve as weaknesses or strengths in negotiations, often resulting in deadlocks and impacting the European integration process. Based on this, this thesis examines the factors influencing the formation of national preferences, the procedures and strategies of intergovernmental negotiations, and the extent to which the preferences of different participants are reflected in the final policy text. Through an analysis of failed and successful legislative attempts, it explores the power of different member states and institutions and how they reach compromises with the EU level, effectively studying how preferences are ultimately transformed. Ultimately, the analysis reveals that in immigration policy, the transformation of preferences depends on member states' institutional positions, issue stances, and political resource disparities, while also aligning with the EU's pursuit of “solidarity.”
dc.abstract.plNiniejsza praca licencjacka koncentruje się przede wszystkim na procesie legislacyjnym unijnej polityki imigracyjnej, omawiając preferencje i interesy państw członkowskich oraz instytucji stojące za tworzeniem polityki, a także to, w jaki sposób poprzez wyrażanie swoich preferencji wpływają one na ostateczny kształt polityki. Praca ta skupia się na trzech etapach: „jak powstają preferencje, jak są one wyrażane oraz czy zostają ostatecznie uwzględnione”. Analizując te trzy kluczowe aspekty, podejmuje próbę zbadania trajektorii preferencji różnych stron w całym procesie legislacyjnym. Teoretyczną podstawą niniejszej pracy jest liberalny intergubernamentalizm, który podkreśla, że preferencje państw członkowskich nie są statyczne, lecz podlegają wpływowi różnych czynników politycznych, gospodarczych, kulturowych i bezpieczeństwa na szczeblu krajowym. Czynniki te ostatecznie prowadzą do różnic między państwami i mogą stanowić zarówno słabości, jak i atuty w negocjacjach, często powodując impasy i wpływając na proces integracji europejskiej. W oparciu o to praca analizuje czynniki wpływające na kształtowanie się preferencji narodowych, procedury i strategie negocjacji międzyrządowych oraz stopień, w jakim preferencje różnych uczestników znajdują odzwierciedlenie w ostatecznym tekście polityki. Poprzez analizę nieudanych i udanych prób legislacyjnych bada siłę poszczególnych państw członkowskich i instytucji oraz to, w jaki sposób osiągają one kompromisy na szczeblu UE, skutecznie badając proces przekształcania preferencji. Ostatecznie analiza pokazuje, że w polityce imigracyjnej przekształcanie preferencji zależy od pozycji instytucjonalnej państw członkowskich, ich stanowiska w danej sprawie oraz różnic w zasobach politycznych, a jednocześnie wpisuje się w unijne dążenie do „solidarności”.
